Case Summary

Plaintiff, an African-American living in a majority-black area of Chicago, applied for a loan with Defendant-bank, which found that the market value of Plaintiff's home was insufficient collateral to support the size of the loan the Plaintiff sought. The Plaintiff disputed the appraisal value assigned to her home and alleged that the Defendants, the bank and two of its employees, had discriminated against the Plaintiff on the basis of the Plaintiff's race. Plaintiff, an African-American living in a majority-black area of Chicago, applied for a loan with Defendant-bank, which found that the market value of Plaintiff's home was insufficient collateral to support the size of the loan the Plaintiff sought. The Plaintiff disputed the appraisal value assigned to her home and alleged that the Defendants, the bank and two of its employees, had discriminated against the Plaintiff on the basis of the Plaintiff's race. The Plaintiff filed suit on January 23, 1995, against the Defendants in the U.S. District Court for the Northern District of Illinois, alleging violations of federal civil rights statutes, 42 U.S.C. 1981, 1982; the Fair Housing Act, 42 U.S.C. 3605; and the Equal Credit Opportunity Act, 15 U.S.C. 1691(a)(1).

U.S. District Court Judge Elaine E. Bucklo granted Defendants motion for summary judgment on September 23, 1997. Latimore v. Citibank, F.S.B., 979 F. Supp. 662 (N.D. Ill. 1997). Judge Bucklo found that the Plaintiff failed to produce sufficient evidence that the Defendants treated the Plaintiff any different than they treated white customers. The Seventh Circuit affirmed on August 10, 1998. Latimore v. Citibank F.S.B., 151 F.3d 712 (7th Cir. 1998).
