Case Summary

On December 11, 1998, the U.S. Department of Justice filed a lawsuit against Hampshire County under 42 U.S.C. § 2000e, et seq. ("Title VII") in the U.S. District Court for the Northern District of West Virginia. The U.S. sought injunctive and monetary relief, alleging that the defendant participated in employment discrimination on the basis of gender.

Specifically, the U.S. alleged that the Sheriff of Hampshire County, in his official capacity, systematically discriminated against women in hiring for positions as jailers.

On October 5, 1999, the district court (Judge W. Craig Broadwater) entered an order that approved the Settlement Agreement which awarded damages to the plaintiff and enforced non-discriminatory practices in future jailor hiring. Each party bore its own costs and expenses, including attorney's fees.
