On June 14, 1995, two former black employees of defendant filed a lawsuit against defendant under Title VII of the Civil Rights Act of 1964, 42 U.S.C § 1981, and the Illinois Human Rights Act in the U.S. District Court for the Northern District of Illinois. On June 14, 1995, two former black employees of defendant filed a lawsuit against defendant under Title VII of the Civil Rights Act of 1964, 42 U.S.C § 1981, and the Illinois Human Rights Act in the U.S. District Court for the Northern District of Illinois. The plaintiffs, represented by private counsel, asked the court for monetary and injunctive relief, claiming that defendant discriminated against them on the basis of race. Specifically, the plaintiffs argue that defendant discriminated against African-American employees by segregating its offices and denying African-American employees the benefits and superior working conditions of their Caucasian colleagues.

On September 30, 1998, the Court (Judge Williams) granted defendant's motion for summary judgment as to the Illinois Human Rights Act on the ground that judicial review was not permitted if the State Human Rights Commission did not issue a final order on a complaint, but denied defendant's motion for summary judgment with regard to Title VII and Section 1981 claims.

Plaintiffs then sought class certification, but according to the docket, at the time the case was dismissed, the Court had not certified a class.

On July 8, 1999, the Court (Judge Ronald Guzman) dismissed the case when the plaintiffs failed to appear.
