On August 19, 1998, Eickoff, a white non-Hispanic man, filed suit in the United States District Court for the District of Kansas. Plaintiff sued the City of Kansas City and the Consolidated Government of Wyandotte County / Kansas City under Title VII and 42 U.S.C. § 1981. Plaintiffs sought monetary damages and injunctive relief. The case was assigned to Chief Judge Kathryn H. Vratil.

Specifically, plaintiff alleged that defendants refused to consider plaintiff's application for employment because of his race and color. Shortly after filing, plaintiff filed a motion to amend his claim, which the court granted, to include discrimination on the basis of his non-Hispanic status and his male identity. On November 17, 1998, plaintiff filed for class certification. On June 9, 1999, the court granted plaintiff's motion for class certification and initially approved the settlement. Then, on July 29, 1999 the court granted final approval of the settlement.

Unfortunately, due to a lack of available documents, the details of the class certification and settlement are not known.
