The Court addresses the Motion to Dismiss filed by Defendant which the Court will also consider as a motion for summary judgment and makes the following rulings: As to the Title VII and ADEA claims the Court finds that these claims should be dismissed; the Plaintiff conceedes to the FLSA claim; the Court GRANTS the Motion to Dismiss and/or for summary judgement as to the Fifth Amendedment claim as well as the good faith and fair dealing claims and the negligent infliction of emotion distress claim. This leave the breach of contract claim and the intentional infliction of emotional distress. Before the Court rules on these claims the Plaintiff is asked to try to contact some lawyers who may take his case.
