RECAP
31 Aug. 19, 2014

TEXT ORDER: This matter is before the court pursuant to the motion of Defendant Calhoun County School District ("District") for declaration of unitary status and dismissal of related school desegregation cases. (ECF No. 21 (C/A No. 66-00598-JMC); ECF No. 18 (C/A No. 70-00563-JMC).) In considering the merits of the motion for declaration of unitary status, the court concluded that the significance of the relevant issues required that the court hear from parties in person. As a result, the court scheduled a status conference for August 22, 2014 at 10:00 a.m. At the status conference, the parties are expected to communicate to the court on the record how the District has satisfied the standard for declaration of unitary status by complying in good faith for a reasonable period of time with the desegregation decree, by eliminating the vestiges of prior de jure segregation to the extent practicable, and by making a good faith commitment to the whole of the court's orders and to those provisions of law and the Constitution that were the predicate for judicial intervention in the first place. Signed by Honorable J Michelle Childs on 8/19/2014. (asni, ) (Entered: 08/19/2014)
