This case is a challenge under the ADA (42 U.S.C. 812132), RA (29 U.S.C. 794) and Minnesota state law to the failure of St Paul Minneapolis police department to provide a certified ASL interpreter for a deaf person who was arrested and charged with assault and interference with a 911 call. The plaintiff, a deaf woman represented by the Minnesota P&A, on July 30, 2017 filed suit against the St Paul for compensatory and punitive damages, civil penalties and attorneys fees (a related lawsuit with the same parties was filed in state District court for injunctive and declaratory relief). The case was assigned to Judge Patrick Joseph Schiltz and later transferred to Judge David T. Schultz on October 1, 2019.

Following a dispute with her mother, the plaintiff attempted to file a report in support of a domestic violence allegation against her mother. She requested a certified ASL interpreter, but the St Paul police department did not provide one; instead providing an officer who had some facility with ASL, but was not fluent and was not a certified interpreter. Instead of taking her statement, the police instead arrested her, without effectively informing her of the reason for her arrest due to the lack of a certified interpreter. Despite repeated attempts to file a statement with an interpreter, the police refused to provide one and arrested her a second time on enhanced charges. 

The plaintiff brought the case against the City of St Paul as the operator of the St Paul Police Department, alleging that the defendant’s failure to provide a qualified interpreter that would allow her to file a domestic assault charge deprived her of the equal opportunity to participate in and benefit from the defendant’s service of allowing people to file domestic assault charges and violated the prohibition against discrimination in Title II of the ADA (42 U.S.S. 12132 and its implementing regulations (28 C.F.R. Part 35). She also alleged that the failure to provide a certified interpreter violated those same provisions by failing to properly advise her as to the nature and reason for her arrest. The plaintiff further alleged that the defendant’s actions violated the RA Act (29 U.S.C. 794) due to federal funding received by the St Paul police department.

On November 21, 2018 the City of St Paul filed a motion for summary judgment, which was granted in part and denied in part. The court found that the city of St Paul could not be held vicariously liable for any deliberate indifference by its employees under Title II of the ADA or the RA. Despite the fact that the St Paul Police Department was in violation of a prior settlement regarding the use of certified ASL interpreters, the Court found that neither the policy nor practice of the police department were believed to be likely to result in a violation of the ADA or RA. However, it found that direct liability could be established due to the actions of a particular police officer who had the authority to address the alleged discrimination and to institute corrective measures and was deliberately indifferent in failing to do so, specifically in relation to the failure to effectively inform her of the reasons for her arrest. Gebser v. Lago Vista Independent School District, 524 U.S. 274, 290 (1998).

The case thereafter ended in settlement and the plaintiff voluntarily dismissed the case on March 13, 2020.
