A student with disabilities sued the Pasadena School District in federal district court, Central District of California, for denial of a free appropriate public education under the IDEA, appealing the decision of a hearing officer that had ruled in the school's favor.  The case was assigned to Judge Michael W. Fitzgerald.  Per the complaint, the school was slow in ordering a special education evaluation, did not assess her in all areas of suspected disability, and failed to provide transition services although she was of age to do so. Once evaluated, the school then proposed only non-public school options that were not the student’s least restrictive environment ( LRE). The parent placed the student in private school at their own expense sued for reimbursement. 

The district court found in favor of the parent on a partially favorable summary judgment motion on January 26, 2021 and ordered tuition reimbursement and attorneys fees on November 17, 2021.  The court found that the district violated the IDEA “…by failing to take steps to evaluate …for special education services until January 2018 and by failing to assess her for post-secondary transition services. The Court also concluded that the school selected by the parents was a proper placement under the IDEA, as it was specifically designed to address the educational and social-emotional needs of twice-exceptional children who demonstrated significant improvement after her enrollment…” The case was closed on Feb 18, 2022.

The District is ORDERED to reimburse Parents in the amount of (1) $9,635, for Bridges tuition costs incurred during the 2017-2018 school year; and (2) $3,695.20, for costs incurred for Student's psychological counseling from December 2017 through the end of the 2017-2018 school year, proportionally discounted by Parents insurance coverage. The District is further ORDERED to pay Plaintiffs' reasonable attorneys fees in the amount of $115,915.58. In addition, Plaintiffs are ORDERED to file, on or before September 13, 2021, (1) a chart calculating Parents' transportation costs to and from Bridges incurred during the 2017-2018 school year, and (2) a chart identifying the sessions Student spent with Dr. Leach during the 2018-2019 school year that were focused on independent living tasks. The District may (but is not obligated to) file a response on or before September 20, 2021.
