Case Summary

This is a case about a third party’s access to medical records in a settlement agreement. On August 6, 2003, Connecticut Office of Protection and Advocacy For Persons with Disabilities, Connecticut’s P&A, filed this lawsuit in the U.S. District Court for the District of Connecticut against the warden of Northern Correctional Institution in his official capacity. Represented by itself with a coalition of legal advocacy organizations serving as co-counsels, the Connecticut P&A alleged that the correctional facility placed incarcerated individuals in unlawfully substandard living and treatment conditions. Allegations were brought under § 1983 and asserted that the federal HIPPA law authorized access to medical records. Judge Donna F. Martinez initially presided over this matter and the case was later assigned to Judge Robert N. Chatigny.

This case concerned the conditions of individuals with psychiatric disabilities in an adult correctional facility. On March 8, 2004, the parties reached a settlement agreement on monitoring the conditions concerning these individuals for three years. The settlement provided $177,850 in attorney fees and $13,131.16 in costs. However, the parties still disagreed on whether HIPPA barred third party consultants from accessing certain individual health records at the correctional facility. The case did not concern the P&A’s records access authority for these records. On September 22, 2005, the parties reached a settlement agreement on the third party consultant records access dispute. On October 11, 2005, the P&A filed a Motion for Attorney Fees. On October 4, 2006, the court rejected the Motion for Attorney Fees. The parties continued to dispute aspects of the settlement. On October 3, 2008, the court issued a Corrected Order on the Settlement Agreement. This represents the date of the last known court filing and the case is believed to be closed.
