Case Summary

(This summary is temporary, while we research the case.) The Disability Rights North Carolina (“Disability Rights”) and six named plaintiffs brought this lawsuit against the North Carolina Department of Transportation, alleging that the defendants violated Title II of the Americans with Disabilities Act for requiring unwarranted road testing and medical reviews; imposing arbitrary license restrictions; relying on discriminatory policies; forcing the plaintiffs to bear the cost and burden of additional testing; and the lack of administrative rules promulgated to govern the defendants' administration of its driver medical review program.
