This is a case about a Protection and Advocacy (P&A) agency’s records access authority for outpatient assessment peer review records for a deceased minor. On May 7, 2004, Oregon’s Clackamas County filed this lawsuit against Oregon Advocacy Center (OAC), Oregon’s P&A, in the U.S. District Court for the District of Oregon. Clackamas sought declaratory relief that OAC were not entitled to receive records under the Protection and Advocacy for Individuals With Mental Illness Act (PAIMI) for a minor who died in her grandmother’s care and previously received an outpatient mental health assessment from Clackamas. Represented by itself, OAC filed a counterclaim arguing that they were entitled to these records under the PAIMI Act. Magistrate Judge John A. Jelderks presided over this matter.

This case arose after OAC established probable cause that abuse or neglect may have contributed to the minor’s death. Initially, Clackamas provided OAC records upon receiving consent from the deceased minor’s mother for all records besides peer review reports concerning her mental health assessment by Clackamas. Clackamas argued that they were not a facility in this context under the PAIMI Act because they provided this assessment in an outpatient setting and did not serve the deceased individual in an inpatient context. Both parties filed Motions for Summary Judgment. In January 3, 2006, the court granted Clackamas’s Motion for Summary Judgment. The court reasoned that Clackamas was not a provider OAC could access records from in this context because they only provided the deceased minor a one-time outpatient assessment. Moreover, the court explained that the PAIMI Act permits advocacy services to individuals living in a private home setting, but that this advocacy did not include records access authority. The case closed in January 2006.  OAC filed a notice of appeal to the 9th Circuit, but the parties agreed to dismiss the appeal before filing briefing.
