This is a case challenging Spokane County’s policy of incarcerating individuals without a hearing for nonpayment of legal financial obligations—the fines, restitution, and court costs that can accompany a felony conviction. In 2003, the Washington Legislature transferred authority to enforce the payment of legal financial obligations from the Washington State Department of Corrections to county clerks. The county then adopted a process of arresting individuals for nonpayment. Arrested individuals could then either remain in jail until they received a hearing or be immediately released after signing an agreement (“auto jail order”) to make monthly payments toward their legal financial obligations and self-report back to jail if they became delinquent on those payments. If individuals failed to report back to jail after defaulting on their monthly payments, they could then be charged with a separate offense punishable by more jail time.  

On December 3, 2010, the plaintiff, a Spokane County resident who spent at least 20 days in Spokane County Jail as a result of the county’s policies, filed this class-action lawsuit in the U.S. District Court for the Eastern District of Washington. The plaintiff sued Spokane County under 42 U.S.C. § 1983. Represented by private counsel, she sought damages as well as costs and attorneys’ fees. She claimed that the county violated the Due Process Clause of the Fourteenth Amendment by incarcerating individuals without first determining their ability to pay in a hearing before a judicial officer. The case was assigned to Judge Rosanna Malouf Peterson. 

The plaintiff requested class certification and defined the class as “[a]ll individuals who were incarcerated in the Spokane County Jail between December 3, 2007 and December 2, 2010, for failure to comply with an ‘Order Enforcing Sentence-LFO’ without first appearing before a judicial officer in a hearing where the judicial officer ordered incarceration after inquiring into the financial ability of the individual to comply with court ordered payments and the degree of willfulness related to the non-payment that was the basis for the incarceration.”  

The parties engaged in discovery over the course of the next year. Then, on February 13, 2012, the parties jointly moved for preliminary approval of a proposed settlement agreement. The proposal included payment of about $75 for each day a class member was incarcerated for failure to report to jail pursuant to an auto jail order. The agreement provided for $271,375 payment by the County, with $40,000 designated for the plaintiffs’ costs and attorneys’ fees. Judge Peterson granted preliminary approval for the settlement on March 21, 2012. 

A few months later, the parties moved jointly for final approval of the settlement agreement, and Judge Peterson heard oral argument on this issue on June 11, 2012. Two days later, she granted final approval of the settlement agreement and awarded $83,623.35 for the plaintiffs’ attorneys’ fees, $1,205.50 for expenses, and $10,000 as an incentive award to the named plaintiff. The case is now closed.
