This case challenged a Mississippi law requiring that second-trimester abortions be performed in hospitals or ambulatory surgical centers. On June 29, 2004, Jackson Women’s Health Organization, an abortion provider, filed this lawsuit in the Southern District of Mississippi on behalf of itself and its patients. The Clinic sued the Mississippi State Department of Health, Hinds County, and the state of Mississippi under the Fourteenth Amendment of the U.S. Constitution. Represented by the Center for Reproductive Rights, the Clinic sought injunctive and declaratory relief. They claimed that because no regular abortion provider was licensed as a hospital or ambulatory surgical facility ("ASF") and under state law as interpreted and applied they were unable to become licensed as such, the Mississippi law presented an unconstitutional burden on individuals’ right to access abortion services. The case was assigned to Judge Tom S. Lee.

Upon filing, the Clinic requested a temporary restraining order and preliminary injunction of the law. Judge Lee granted the temporary restraining order on July 2, and granted the preliminary injunction July 22, 2004. Judge Lee reasoned that the Clinic had a substantial likelihood of success on the merits of their lawsuit, and that the Mississippi law likely presented an undue burden on abortion access under the standard provided by the U.S. Supreme Court in Planned Parenthood v. Casey. 330 F.Supp.2d 820

The parties proceeded to discovery. In late January 2005, the Clinic moved for summary judgment, and then filed an amended complaint in February. In June 2005, Judge Lee granted the Clinic's motion for summary judgment and issued a permanent injunction enjoining enforcement of the law. Judge Lee reasoned that the law as it stood acted as an effective ban on the performance of second-trimester abortions, which had previously been held to be unconstitutional. 2005 WL 1412125.

Following the permanent injunction, Judge Lee granted the Clinic attorneys’ fees. The case is now closed.
