This was a challenge to the congressional redistricting plan adopted by the State of Illinois after the 2010 census (the “Adopted Map”). Plaintiffs were an organization called the Committee for a Fair and Balanced Map (a not for profit organization created by Illinois citizens concerned about the congressional redistricting process in Illinois), ten incumbent Republican members, ten incumbent Republican members of Congress, and six registered voters (including some who identify themselves as Latino voters and others who assert that they are Republican voters). The defendants are the Illinois State Board of Elections (the agency charged with implementing the results of the redistricting process) and its members.

On July 27, 2011, plaintiffs filed a complaint alleging that the Adopted Map violated Section 2 of the Voting Rights Act, 42 U.S.C. § 1973(a) (Count I), the Equal Protection Clause of the Fourteenth Amendment, and the Fifteenth Amendment because Congressional Districts 3, 4, and 5 in Illinois were drawn intentionally to dilute the Latino vote (Counts II and III). Plaintiffs also alleged violation of the Equal Protection Clause because Latino ethnicity was the predominant consideration in drawing Adopted District 4 and as such, was an intentional and unjustified racial gerrymander (Count IV). Plaintiffs further contended that Adopted Districts 11, 13 and 17 demonstrated a blatant partisan gerrymander against Republican voters in violation of the First and Fourteenth Amendments (Counts V and VI).

Plaintiffs sought declaratory judgment on all counts and to enjoin defendants from enforcing or giving any effect to the proposed district boundaries as drawn in the Proposed Congressional Plan, including enjoining defendants from conducting any elections for the United States House of Representatives based on the Adopted Map. Plaintiffs further sought to compel the Board to conduct elections for the United States House of Representatives based on a redistricting plan chosen by the Court that complies with the Voting Rights Act and the Constitution. Plaintiffs further sought attorneys’ fees pursuant to 42 U.S.C. § 1988 and as authorized by 42 U.S.C. §1973l(e).

The court held a two-day trial on plaintiff’s motion for permanent injunction. On December 15, 2011, found in favor of defendant. As to the partisan gerrymander claims, although the Court agreed that the crafting of the Adopted Map was a blatant political move to increase the number of Democratic congressional seats, the Court ultimately concluded that plaintiffs failed to present a workable standard by which to evaluate such claims. As to plaintiffs' vote dilution claims, those failed because plaintiffs had not proven by a preponderance of the evidence that the state legislature intentionally discriminated against Latinos in passing the Adopted Map. The Court again recognized that Latino ethnicity was a factor in creating District 4 in 1991, but the weight of the evidence showed that the predominant intent of the 2011 Illinois legislature in maintaining Adopted District 4 in substantially the same shape as when it was created in 1991 was a desire to enhance Democratic seats in the state as a whole, to keep Democratic incumbents in Districts 3, 4, and 5 with their constituents, to preserve existing district boundaries, and to maintain communities of interest. Because race was not the predominant factor, plaintiffs failed to meet its burden of proof on its racial gerrymander claims under Section 2 of the Voting Rights Act or the Constitution.
