Case Summary

This is a case about data collection on lending to women-owned, minority-owned, and small businesses. On May 14, 2019, the California Reinvestment Coalition (CRC) filed this lawsuit against the Consumer Financial Protection Bureau (“the Bureau”) and its Director Kathy Kraninger in the U.S. District Court for the Northern District of California. § 1071 of the Dodd-Frank Wall Street Reform and Consumer Protection Act (“§ 1071”) of 2010 required that the Bureau collect and publish, annually, data regarding lending to women-owned, minority-owned, and small businesses, including data describing loan applications and how they were actioned. The CRC alleged that the Bureau never published this data, but instead engaged in planning through 2017. In 2018, then-Acting Director Mick Mulvaney actively disengaged in discussions about how to implement § 1071, fired all 25 members of the Bureau’s Consumer Advisory Board, and postponed its next § 1071 pre-rule activities from May 2018 to March 2019 and placed § 1071 on the “Long-Term Agenda.”

In this lawsuit, the CRC alleged that the Bureau’s failure to collect data violated the Administrative Procedure Act (APA), 5 U.S.C. § 706, by failing to follow § 1071 as required. The CRC alleges that this failure harmed small businesses and harmed supporting organizations (like the CRC)’s ability to detect and address obstacles to obtaining credit faced by women, ethnic minorities, and small business owners. Represented by Democracy Forward as well as private counsel, CRC sought declaratory relief, including a declaration that the Bureau’s attempt to offload their responsibilities directly onto financial institutions was invalid; injunctive relief in the form of a requirement that the the Bureau promptly implement Section 1071 and begin collecting and publishing the required data; and reimbursement of CRC’s attorney’s fees and costs.

On June 27, 2019, the CRC amended their complaint to add three new plaintiffs. The CRC added the National Association for Latino Community Asset Builders, a San Antonio nonprofit with the mission of strengthening the economy by advancing economic mobility in Latino communities. The CRC also added two individual women-owned small-business plaintiffs (these plaintiffs' races were not mentioned) who alleged limitations to their business based on inability to obtain financing, despite qualifying factors.

On August 30, 2019, Judge Jeffrey S. White ordered that the case be referred to mediation. On October 11, 2019, the CRC and other Plaintiffs moved for summary judgment; on November 8, 2019, the Bureau also moved for summary judgment. On February 26, 2020, the Parties, through the CRC, filed a mutually-stipulated Settlement Agreement and Proposed Order with the Court. In the Settlement Agreement the Parties agreed that the Bureau would:

Outline proposals for collecting the required Section 1071 data and publicly release those proposals for consideration of their effect on small businesses by September 15, 2020.
Convene a Small Business Advocacy Review panel to provide input on its proposal by October 15, 2020. The Bureau will take panelist suggestions from the small business plaintiff groups.
Negotiate deadlines for each stage of the rulemaking process to facilitate the data collection.
Submit status reports every 90 days detailing the Bureau’s progress toward implementing this data collection law.

They also agreed that each party would bear their own litigation and Agreement costs. On February 26, 2020, Judge White granted the Stipulation of Settlement.

Since then, the Bureau has filed ten (10) on-time status reports as required by the Settlement Agreement. On July 16, 2021, the Parties set, and Judge White approved, a deadline for when the Bureau must issue the Notice of Proposed Rulemaking: September 30, 2021. On September 1, 2021, the Bureau released its proposal for implementing Section 1071 of the Dodd-Frank Act. On July 8, 2022, the CRC and Plaintiffs submitted March 31, 2023, as the date by which the Bureau must issue a final rule on small business lending data collection. Judge White approved on July 11, 2022. The case is ongoing as the Bureau must continue to submit status reports until it issues its final rule.
