This case involved a Black transgender woman who was incarcerated by the Georgia Department of Corrections (“GDC”). In 2015, she successfully sued GDC officials after challenging its policies for failing to protect transgender people from sexual assault and failing to provide them adequate treatment for gender dysphoria. 131 F. Supp. 3d 1346 (M.D. Ga. 2015). After a parole violation, she was incarcerated again by GDC. The Center for Constitutional Rights and the Southern Poverty Law Center subsequently filed this lawsuit on her behalf on November 23, 2020.

Pursuant to 42 U.S.C. § 1983, the plaintiff’s amended complaint alleged that GDC had once again failed to protect her from repeated sexual assaults and that it refused to provide her with constitutionally adequate treatment for gender dysphoria. The plaintiff alleged that GDC acted in violation of the Eighth Amendment under various theories of liability, including Monell and supervisory liability. The complaint also alleged that GDC violated the plaintiff’s rights to equal protection and privacy under the Fourteenth Amendment. The plaintiff sought declaratory and injunctive relief; compensatory, nominal, and punitive damages; and attorneys’ fees and costs. This case was initially filed in the U.S. District Court for the Northern District of Georgia but was transferred to the U.S. District Court for the Middle District of Georgia on December 1, 2020. This case was assigned to Chief U.S. District Judge Marc T. Treadwell thereafter.

On April 9, 2021, the plaintiff filed a motion for protective order to enjoin the defendants from retaliating or taking adverse actions against her. That same day, the plaintiff also filed a motion for preliminary injunction to, inter alia, order GDC to transfer her to a female facility for the remainder of her time in custody and provide her with medically necessary treatment for gender dysphoria. The latter motion was eventually consolidated with the trial on the merits. Later that month, the United States filed a statement of interest affirming that prison officials’ failure to protect all prisoners from sexual abuse and assault violated the 8th Amendment to the U.S. Constitution.

While this case was ongoing, the plaintiff was released on parole from GDC custody on August 1, 2022. That same day, GDC filed a motion for relief from bi-weekly reporting, as required by a court order that was issued on March 28, 2022. The next day, GDC moved to dismiss the plaintiff’s claims for declaratory and injunctive relief on the grounds of mootness, which the plaintiff did not contest. The following week, the plaintiff withdrew her motions for preliminary injunction and protective order. On August 9, 2022, the court issued an order granting without prejudice GDC’s motion to dismiss but allowed the plaintiff’s claims for monetary damages to proceed. The court also granted GDC’s motion for relief from bi-weekly reporting, which the plaintiff did not oppose.

A jury trial as to damages is set to proceed in January 2023.
