On December 7, 2022, two female former employees of Twitter filed a class action suit against Twitter in the U.S. District Court for the Northern District of California. Plaintiffs alleged that the layoffs at Twitter following Elon Musk's acquisition of the company impacted female employees to a greater extent than male employees, violating Title VII, 42 U.S.C. § 2000e, and the California Fair Employment Act in the process. Plaintiffs sought immediate injunctive relief ensuring Twitter does not violate the law in their hiring and retention practices and enjoining Twitter from seeking releases from other employees, as well as a declaratory judgment, monetary damages, and attorneys’ fees. This case was assigned to Judge Jon S. Tigar. 

Plaintiffs alleged that after Musk's acquisition of the company, mass layoffs affected more than half of Twitter's workforce and were made without regard to job performance, experience, or abilities. 57% of female employees were laid off while 47% of male employees were laid off. Plaintiffs relied on statistical analysis by an economics professor to show that this percentage difference was statistically significant. Plaintiffs also highlighted Musk's history of sexist public comments to argue that the gender disparity in the layoffs was intentional. 

On January 26, 2023, Twitter filed a motion to dismiss the complaint for failure to state a claim and strike the class claims. Twitter argued that Plaintiffs failed to exhaust administrative remedies, did not allege facts sufficient to support a plausible disparate treatment or disparate impact claims, lacked proper standing, and failed to state a viable “case or controversy”. 

On May 8, 2023, the court granted Twitter’s motion to dismiss on all claims finding that Plaintiffs failed to exhaust administrative remedies by filing suit before obtaining right-to-sue notices, failed to allege sufficient facts about their positions, job performance, or similarly situated male employees who were retained, and failed to allege causation between the Reduction-in-Force (“RIF”) practice and their own layoffs due to lack of basic facts about their positions and qualifications. The court dismissed the case with leave to amend within twenty-one days. 

On May 26, 2023, Plaintiffs filed an amended complaint. The amended complaint added X Corp. as a defendant, reflecting the corporate merger that occurred, and a new individual plaintiff. Further, the amended complaint expanded extensively on the factual allegations and added an Age Discrimination in Employment Act (ADEA) claim and California FEHA age discrimination claim, alleging that older employees were also discriminatorily targeted. Plaintiffs, in their amended complaint, also eliminated the request for declaratory judgment and removed allegations about Twitter seeking releases from employees without proper notice. 

On June 16, 2023, Twitter filed a motion to strike portions of the amended complaint arguing that the age discrimination claims should be struck by the court because the court only permitted Plaintiffs to amend their complaint “solely to cure the deficiencies identified” by the court’s order. Twitter also argued that the new plaintiff should be struck as well. 

On September 18, 2023, the parties filed an order to stay the case pending mediation until January 2, 2024. The court filed an order to stay the case the next day. 

On January 4, 2024, the stay was lifted. Also, on that day, the court granted Twitter’s motion to strike the portions of the amended complaint addressed above. 

On January 19, 2024, Plaintiffs filed a second amended complaint. The second amended complaint removed the new individual plaintiff and all allegations regarding age discrimination. 

Defendant X Corp. filed a motion to dismiss the second amended complaint for lack of subject-matter jurisdiction and for failure to state a claim on February 9, 2024. On August 26, 2024, the court granted the motion with leave to amend. The court found that although Plaintiffs satisfied the exhaustion of administrative remedies requirement, they still failed to plausibly allege a disparate treatment claim and a disparate impact claim. Plaintiffs, again, were permitted to file an amended complaint within twenty-one days. 

On September 26, 2024, Plaintiffs filed their third amended complaint. The third amended complaint added new factual allegations alleging that both plaintiffs were laid off on the same date, November 4, 2022, despite performing as well as or better than male employees who were not laid off. The third amended complaint also updated the statistical data. 

The parties jointly requested that the court consolidate this case with Turkal v. Twitter, Inc., No. 4:24-cv-04054-JS, for all purposes, including trial. The court granted this request on October 30, 2024, and this case remained the lead case. 

On April 25, 2025, Plaintiffs filed a motion for class certification. Plaintiffs sought to certify a class “that includes all women who were notified of their layoff by Twitter on November 4, 2022.” 

On August 27, 2025, the parties notified the court that they reached a settlement agreement. On September 2, 2025, the court filed an order of dismissal upon settlement. On October 29, 2025, the parties stipulated that the settlement agreement would be finalized by February, 2026 and asked that the court grant them until March 10, 2026, in which to file a motion to vacate the dismissal order should settlement not occur by that time. The settlement agreement is not yet available to the Clearinghouse. 

As of April 18, 2026, this case is ongoing.
