On February 7, 2023, two individuals filed this putative class action lawsuit on behalf of themselves and other individuals with mobility disabilities in the United States District Court for the Eastern District of California. The case was assigned to Chief District Judge Kimberly J. Mueller. The plaintiffs sued the city of Sacramento and Sacramento County under the Americans with Disabilities Act (ADA), the Rehabilitation Act, and state law. Represented by private counsel, the plaintiffs sought declaratory and injunctive relief. They claimed that the defendants' failure to maintain clear sidewalks had violated their right to access public accommodations. 


The plaintiffs sought to certify a class defined as “all Sacramento residents with mobility disabilities who have used, use, or will use, the sidewalks in the defendant city, and defendant county, through the date of judgment in the action.”

The plaintiffs specifically alleged that the defendants had violated the ADA, Rehabilitation Act, and state law by failing to clear sidewalks of debris and tent encampments of unsheltered people. The plaintiffs claimed that a rise in the population of unsheltered people had left sidewalks covered by shelters, leaving people with disabilities unable to utilize the sidewalks because they were completely blocked by these shelters. 

The plaintiffs filed an amended complaint on April 19, 2023. The amended complaint added three new named plaintiffs and included detailed factual allegations about each plaintiff’s experiences with sidewalk tent encampments. It also modified the requested relief to seek statutory damages rather than specific monetary damages. 

Both the City and County moved to dismiss on June 2, 2023. On October 5, 2023, Judge Mueller granted the motions to dismiss in part, dismissing three individual plaintiffs' claims with leave to amend due to lack of standing, because they hadn't alleged encountering barriers on County sidewalks. The court also struck three paragraphs from the complaint. On October 23, 2023, the remaining plaintiff filed a second amended complaint against both defendants, narrowing the case to federal ADA and Rehabilitation Act claims.

In October 2024, the case was reassigned to District Judge Dena M. Coggins. 

In early 2025, the parties engaged in a discovery dispute referred to Chief Magistrate Judge Carolyn K. Delaney for informal resolution. An informal discovery conference took place on March 7, 2025, at which counsel for all parties discussed the dispute and their ongoing meet-and-confer efforts. That same day, Judge Coggins referred the case for a court-supervised settlement conference, noting that a private mediation conducted in November 2023 had been unsuccessful.

On June 2, 2025, the plaintiff filed a notice with the court that it had entered a private settlement agreement with Sacramento County, the details of which are unavailable to the Clearinghouse. A settlement conference took place later that month to resolve the remaining claims against the City of Sacramento, but those claims were not resolved. 

On July 21, 2025, Judge Coggins granted the plaintiffs’ request to voluntarily dismiss their claims against Sacramento County; the individual claims against the County were dismissed with prejudice, and the class action claims against the County were dismissed without prejudice. This left the City of Sacramento as the only remaining defendant.

As of April 2026, the case is ongoing.
