This case is about a protection and advocacy (P&A) agency’s representation of a student plaintiff who sought appropriate supports from his school district.

On February 5, 2021, Disability Rights Maine (ME) filed this lawsuit on behalf of a student in the United States District Court for the District of Maine. Disability Rights ME alleged that the Regional School Unit No. 73 violated the Individuals with Disabilities Education Act (IDEA) and Title II of the ADA when it subjected the student to discipline and failed to provide the positive behavior interventions and supports, related services, and specialized instruction he required. Judge Lance Edward Walker presided.

This lawsuit began after a school in the Regional School Unit 73 removed the student from his classroom, and his school, to a segregated tutoring placement. Both parties filed motions for judgement on the administrative record and the defendant school district filed a counterclaim against the plaintiff. On July 14, 2022, the court ruled for the plaintiff in part and for the defendant in part. Both parties appealed to the First Circuit. On December 6, 2022, the First Circuit entered a joint voluntary dismissal of the appeal.

On January 18, 2023, the parties settled. The terms of the settlement are unknown to the Clearinghouse at this time. The case is now closed.
