This case involved a class action lawsuit alleging the Baton Rouge Police Department engaged in a practice of strip-searching individuals and taking them into custody without probable cause or reasonable suspicion. On September 29, 2023, an individual plaintiff filed this lawsuit against the City of Baton Rouge and the Chief of the Baton Rouge Police Department, in his official capacity, in the U.S. District Court for the Middle District of Louisiana. The plaintiff alleged violations of the Fourth Amendment of the U.S. Constitution pursuant to 42 U.S.C. § 1983. The plaintiff sought compensatory and punitive damages to each member of the proposed class, a declaratory judgment declaring the defendant’s policy unconstitutional, as well as a preliminary and permanent injunction enjoining the defendant from continuing their policy. The plaintiff was represented by private counsel. 


The plaintiff alleged that the Baton Rouge Police Department maintained a policy and/or practice of strip-searching individuals who had not been arrested. They alleged that the defendants strip searched individuals prior to establishing probable cause to bring criminal charges and do so to serve the purpose of obtaining evidence to be used against the individual.

On February 21, 2024, the court held the first scheduling conference, during which the parties discussed their failure to file a timely joint status report. The court scheduled another conference for March 20, 2024, and directed the plaintiff to file an amended complaint, which was filed on March 22, 2024. A scheduling order followed on August 9, 2024.

In early 2025, the plaintiff filed a motion for default judgment on January 20, which the court denied on March 6, 2025, after defendants sought leave to file a late response.

On August 15, 2025, the court issued a new scheduling order. On September 26, 2025, the court entered a 60-day order of dismissal, indicating that the case would be closed if no further action was taken during that period.

As of September 2025, the case remained pending under the court’s 60-day dismissal order.
