This case is about Texas Senate Bill 6, which established Texas’s new congressional districts after the 2020 census. The Governor of Texas signed Senate Bill 6 into law on October 25, 2021. The same day, Voto Latino, a non-profit Latino voting rights organization, along with individual Latino and African-American registered voters filed this lawsuit in the U.S. District Court for the Western District of Texas (Austin). Plaintiffs named the Governor of Texas and the Texas Secretary of State as defendants, alleging that Senate Bill 6 violated Section 2 of the Voting Rights Act, 52 U.S.C. § 10301. The plaintiffs were represented by private counsel, and the case was assigned to U.S. District Judge Robert L. Pitman.

Voto Latino and the individual registered voters alleged that the proposed congressional districts strategically "cracked and packed" Latino and African-American communities to dilute their voting power and to ensure 60 percent of congressional districts had a majority of white voters, despite white Texans constituting less than 40 percent of the state’s total population. The plaintiffs requested a declaration that Senate Bill 6 violated the Voting Rights Act, an order barring further elections under Senate Bill 6’s congressional districts, an order requiring adoption of a new redistricting plan, and attorneys’ fees.

The defendants filed a motion to dismiss on November 16, 2021. First, they argued that both all plaintiffs lacked standing to sue. Second, they argued that Section 2 of the Voting Rights Act only allowed the Attorney General, not private plaintiffs, to file a suit.

On November 19, 2021, the district court consolidated the case with several other pending challenges to Texas’s redistricting plan. The consolidated cases were assigned to a three-judge panel composed of Judges David C. Guaderrama, Jerry E. Smith, and Jeffrey V. Brown. League of United Latin American Citizens (LULAC) v. Abbott was designated the lead case.

On May 23, 2022, the three-judge panel issued an opinion dismissing the plaintiffs’ claims from Voto Latino insofar as they challenged Congressional Districts 2, 20, 34, and 35, and the six unspecified (in the complaint) districts near Dallas-Fort Worth because the Voto Latino organization lacked standing and none of the individual registered voters lived in those districts.

As of July 2025, LULAC v. Abbott remains ongoing.
