This is a case about a challenge to Georgia's congressional redistricting plan.

In 2011, the Georgia General Assembly passed a congressional redistricting plan that plaintiffs alleged was for the purpose of ensuring that the increasing minority population did not translate into minority voting power or political influence.

On June 13, 2018, four African American Georgian voters filed a lawsuit in the U.S. District Court for the Northern District of Georgia Atlanta Division against the Georgia Secretary of State. The plaintiffs alleged that the 2011 congressional redistricting plan prevented African American voters from forming a voter majority in the 12th Congressional District by forming district boundaries in a way that increased the number of white voters and split up minority voters, particularly African American communities. This decreased the percentage of Black eligible voters in the District, preventing Black voters from electing the candidates they preferred. The voters allege that the plan violated Section 2 of the Voting Rights Act and that the General Assembly was required to draw an additional congressional district in or around District 12 so that African American voters can have the opportunity to elect the candidates they desired. Represented by private counsel, the plaintiffs sought declaratory and injunctive relief, a new congressional redistricting plan, and other additional relief as appropriate. The case was first assigned to Judge Mark H. Cohen; after his recusal, the case was reassigned to Judge William S. Duffey, Jr. The case was reassigned to Judge Richard W. Story on July 2, 2018. 

On July 5, 2018 the defendant filed a motion to dismiss, and the next week, on July 13, the plaintiffs amended their complaint. In this amendment, three more African American Georgian voters were added. On August 3, the defendant submitted to the District Judge another motion to dismiss. A few days later, on August 9, Judge Richard W. Story denied the motion to dismiss because the amended complaint rendered the defendant’s motion moot.

On May 1, 2019, the defendant filed a motion for summary judgment and the plaintiffs filed a motion for partial summary judgement.  

The case was then reassigned to Judge Jean-Paul Boulee on June 17, 2019 with the defendant’s motion for summary judgment and the plaintiffs’ motion for partial summary judgement being filed with Judge Boulee the next day. 

On March 25, 2020, the court denied as moot plaintiff’s motion for partial summary judgement and defendant’s motion for summary judgment because the court found that hearing both parties’ oral argument was appropriate, particularly regarding the plaintiffs’ alleged delay in bringing the case and any alleged undue prejudice to the defendant resulting from the delay. 

On April 13, 2020, both parties stipulated that all of the claims related to the plaintiffs’ amended complaint were dismissed and both agreed that each party would cover its own fees and costs.

The case is now closed.
