Case Summary

Plaintiffs, a group of registered voters in the city of Chicago, challenged Section 34-3 of the Illinois School Code. They alleged that the appointive process for selecting members of Chicago’s Board of Education (“Board”) violated their constitutional due process rights and equal protection guarantees, and Section 2 of the Voting Rights Act and Title VI of the Civil Rights Act of 1964. Specifically, Plaintiffs alleged that of the 859 public school districts in Illinois, only the city of Chicago school district has its school board members appointed by the mayor rather than elected, and that as a result, corruption and mismanagement have occurred, including financial crises, fraud, conflicts of interest and underfunding. Prior to 1995, the appointment of Board members had to be confirmed by Chicago’s City Council, but this is no longer the case.

Plaintiffs' complaint included four main allegations, as follows: (1) discrimination in violation of the Equal Protection Clause of the Fourteenth Amendment and the First Amendment on the ground that Section 34-3 deprives Chicago residents of the right enjoyed by Illinois citizens living outside of Chicago to vote for members of their district’s board of education; (2) pursuant to Section 34-3’s mayoral appointment system, the Board unlawfully exercises the power of taxation without representation in violation of the Equal Protection and Due Process Clauses of the Fourteenth Amendment and of Article IV, section 4 of the Constitution; (3) Section 34-3 amounts to an electoral scheme resulting in the denial of the right to vote on account of race or color in violation of Section 2 of the Voting Rights Act; and (4) under 42 U.S.C § 1983 for the denial of the right to vote on account of race or color in violation of the Fourteenth and Fifteenth Amendments and in violation of Title VI of the Civil Rights Act of 1964.

Plaintiffs sought declaratory and injunctive relief, including seeking an order that the defendants prepare a plan for the direct election of the Board, and an adequate remedy for the alleged violations.

Defendants filed motions to dismiss (one by the city and one by the state), arguing that the complaint failed to state a claim on which relief may be granted. They further argued that the Board was immune from suit under the Eleventh Amendment and that because the plaintiffs did not argue any basis for disputing the assertion of immunity, they have conceded such argument. Defendants also argued that the plaintiffs lacked standing because they did not possess a right to elect the Board.

The court determined that the plaintiffs did have federal subject-matter jurisdiction to proceed. The court agreed with the defendants’ argument that the Board should be immune from suit under the Eleventh Amendment, essentially because plaintiffs did not respond to those arguments directly and therefore conceded the argument. As to the various equal protection claims, the court applied rational basis review, noting that plaintiffs do not have a fundamental right to vote in school board elections as a matter of law and the fact that other citizens of the state do in their district, does not mean plaintiffs have a right to vote in Chicago. The court further found that Section 2 of the Voting Rights Act cannot be used to compel elections for offices that the state has determined to fill through appointments. With respect to due process, the court found that plaintiffs offered no persuasive reason to make a distinction between taxation by a Board accountable to the City Council as compared to the mayor. The court further found that any racial discrimination claims were speculative. The court granted the defendants’ motions to dismiss in February 2017.

Plaintiffs appealed to the Seventh Circuit. In its May 2018 opinion, the Seventh Circuit affirmed the District Court's order.
