This is a sex discrimination class action brought by female student-athletes at the University of Oregon against the University. On December 1, 2023, varsity female student-athletes belonging to the University’s beach volleyball and rowing teams filed this lawsuit in the United States District Court for the District of Oregon. The plaintiffs sued the University under Title IX of the Education Amendments of 1972, 20 U.S.C. § 1681. Represented by Jennifer J. Middleton of Johnson Johnson Lucas & Middleton PC and Arthur H. Bryant of Bailey & Glasser, LLP, the plaintiffs sought class action certification, with the plaintiffs serving as class representatives. In their complaint, plaintiffs sought various remedies, including a declaratory order stating that the University discriminated against its current female varsity student-athletes on the basis of sex and a permanent injunction against such discrimination, along with compensatory and nominal damages. The plaintiffs alleged that the University violated Title IX by failing to provide female varsity student-athletes with the same treatment and benefits provided to it provides male varsity student-athletes. Alleged disparate treatment included failure to provide athletic financial aid to its female and male student-athletes in proportion to the number of students of each sex participating in intercollegiate athletics, and failure to provide female students an equal opportunity to participate in varsity intercollegiate athletics. This case was assigned to Judge Ann L. Aiken.

On the same day the plaintiffs filed their complaint, the court issued a Discovery and Pretrial Scheduling Order. This order requires the parties to complete discovery by April 1, 2024 and to submit a Joint Alternate Dispute Resolution Report by April 29, 2024. 

On April 1, 2024, the court set a settlement conference to occur on July 19, 2024. A pretrial conference took place on May 14, 2024. 

On July 3, 2024, the defendants filed a motion for partial summary judgment (on statute of limitations grounds), a motion for judgment on the pleadings, and a motion to dismiss for lack of jurisdiction. The defendants argued that the claims were time barred and asked the court to dismiss all of plaintiffs’ claims that fell outside the state’s statute of limitations for Title IX claims. In the motion for judgment on the pleadings, the defendants argued that Count I of plaintiffs’ claims should be dismissed on the grounds that they failed to show women’s teams at the university were treated less favorably than men’s teams. The motion to dismiss for lack of jurisdiction alleged that plaintiffs lacked standing because their claims cannot be redressed and because many of the plaintiffs are no longer students at the university, making their claims for injunctive and declarative relief moot. 

The settlement conference took place on July 19, 2024, in front of Magistrate Judge Stacie F. Beckerman, but the parties did not settle. 

On November 7, 2024, the plaintiffs filed responses in opposition to the defendant's motions for partial summary judgment, judgment on the pleadings, and motion to dismiss for lack of jurisdiction. The plaintiffs argued that they did have standing to bring their claims because, in class action suits like this one, only one plaintiff needs standing to confer subject matter jurisdiction over the entire claim, and multiple plaintiffs clearly have standing and non-moot claims. An oral argument on these motions and oppositions was set for February 26, 2025. 

On April 4, 2025, the defendant’s motion to dismiss was granted in part and denied in part. Their motions for judgment on the pleadings and for partial summary judgment were denied. They dismissed some of the plaintiffs claims for lack of standing but allowed the remainder of the claims to proceed because of the “inherently transitory” exception to mootness for claims like this. 

On May 6, 2025, the plaintiffs filed for a protective order on the grounds that some of the relevant information was confidential and therefore protected under Federal Rule of Civil Procedure 26(c) and the Family Educational Rights and Privacy Act of 1974 (FERPA). The defendants agreed that this information should be protected and the motion was granted on May 9. 

A second settlement conference occurred on July 28, 2025, but again, the parties did not settle. 

On September 23, 2025, the plaintiffs filed a motion for class certification. The information/attached documents were sealed according to the previously granted protective order. Many declarations in support of this motion were subsequently filed and some relevant documents were unsealed as needed. The defendants filed a response in opposition to this motion on December 22, 2025. 

The case is ongoing as of February 19, 2026. The motion for class certification has not yet been decided.
