This case is related to disability accommodations under the Americans with Disabilities Act (ADA). On February 22, 2024, two individual plaintiffs represented by Disability Rights Advocates filed this putative class action lawsuit in the United States District Court for the Northern District of California against Hertz, a rental car company. Both plaintiffs require hand controls in order to operate a car as a result of their mobility disabilities, and alleged that defendant's failure to provide hand controls in many of their rental vehicles violated the ADA and an analogous California law. Specifically, the plaintiffs alleged that because Hertz only provided hand controls for a limited number of vehicle types, and these vehicles were often unavailable or more costly, Hertz was discriminating on the basis of disability, failing to provide reasonable accommodations, and imposing a surcharge on people with disabilities. Plaintiffs sought a declaratory judgment, a permanent injunction, damages, and attorneys' fees. They also sought to certify a class of "all potential Hertz customers with disabilities who need hand controls to operate a rental car."

On February 23, 2024, the case was assigned to Judge Maxine M. Chesney. As of January 2, 2025, the case remains ongoing.
