This case involved police dispersal of protestors in Fort Lauderdale on May 31, 2020. Four years later, on May 31, 2024, several protestors filed this lawsuit in the U.S. District Court for the Southern District of Florida against the City of Fort Lauderdale and individual Fort Lauderdale Police Department (“FLPD”) officers under 42 U.S.C. § 1983 and Florida state law. Represented by private counsel, the plaintiffs alleged that FLPD officers used tear gas and kinetic impact projectiles to disperse the crowd without warning or dispersal order. According to the plaintiffs, this police action violated the protestors’ First and Fourteenth Amendment rights. Specifically, the plaintiffs alleged that the defendants restricted the protestors’ ability to peacefully exercise their First Amendment rights and unconstitutionally retaliated against the protestors’ demonstration. The plaintiffs also claimed that the defendants violated the protestors’ procedural and substantive Fourteenth Amendment rights by indiscriminately deploying tear gas and less lethal munitions without notice. The plaintiffs sought class action certification for a damages class and an injunctive relief class. The case was assigned to District Judge Rodney Smith.

On October 22, 2024, several officer defendants filed a motion to dismiss and on October 28, 2024, the City of Fort Lauderdale and additional officer defendants also filed a motion to dismiss. The plaintiffs subsequently amended their complaint on November 12, 2024. This amended complaint rescinded the plaintiffs’ initial Fourth Amendment claim, added a Fourteenth Amendment substantive due process claim, removed several individual officer defendants, and included additional factual allegations. In response, several officer defendants amended their motion to dismiss on November 25, 2024. The City of Fort Lauderdale and additional officer defendants amended their motion to dismiss the day after, on November 26, 2024.

On March 19, 2025, the court referred the case to mediation. On April 11, 2025, the court granted a joint motion to appoint a mediator. 

On April 23, 2025, the court struck the defendant’s most recent motion to dismiss and motion to dismiss for failing to comply with the joint motion requirements specified in a joint scheduling report. The court guided the defendants to file one joint motion to dismiss that complies with the scheduling order by May 2, 2025. In response, the defendants filed another motion to dismiss on May 2, 2025. 

On August 22, 2025, the plaintiff filed a motion to certify class. 

On March 12, 2026, the court filed an omnibus order granting the defendants' motion to dismiss and denying the plaintiff’s motion to certify class. In the order, the court granted the defendants’ motion to dismiss. The court dismissed the Monell claims against the City because plaintiffs failed to establish: (1) a final policymaker delegation theory due to contradictory allegations and lack of factual support; (2) a policy, practice, or custom theory because they failed to show a longstanding and widespread practice and provided contradictory allegations about FLPD's dispersal order policies; and (3) a failure to train theory because they failed to show the City knew of a need to train in particular areas and made a deliberate choice not to act. The Supervising Officers were granted qualified immunity because plaintiffs failed to show the officers violated clearly established constitutional rights. The substantive due process claim failed because the alleged conduct was not sufficiently "conscience shocking." The procedural due process claims failed because adequate state court remedies were available and, lastly, class certification was denied because common questions would not predominate over individualized inquiries
