Four migrants and their putative class challenged two New York counties’ executive orders blocking migrant and asylum seekers from New York City. In early 2023, New York City established “Human Emergency Relief and Response Centers” to accommodate rising migrant numbers. New York City entered into contracts with two hotels in nearby Orange County and Rockland County. The plaintiffs (four of these overflow New York City migrants) opted into the programs, but the executives from both counties (defendants) took steps to block the program by declaring states of emergency. The defendants prohibited the hotels from creating accommodations for the sole reason of housing migrants and asylum seekers. On May 11, 2023, plaintiffs brought a class action complaint in the United States District Court for the Southern District of New York against the defendants, alleging violations of the Fourteenth Amendment’s Due Process Clause, the Fourteenth Amendment’s Equal Protection Clause, Title II of the Civil Rights Act of 1964, and a violation of the New York Executive Law §24. The plaintiffs sought a declaration that the defendants’ conduct violated their constitutional rights. Moreover, they sought for the court to enjoin the defendants from interfering with the plaintiffs’ travel to and within Orange County and Rockland County, along with enjoining the defendants from interfering with the plaintiffs’ housing and shelter within the counties. The court was assigned to Judge Nelson Stephen Roman. The New York Civil Liberties Union, a civil rights and liberties organization, was counsel for the plaintiffs.

 On May 11, 2023, the Supreme Court of Rockland County (a state court) granted a temporary restraining order motion from the defendants, enjoining New York City from transporting 340 homeless adult individuals from New York City to Rockland.

On May 15, 2023, the plaintiffs amended their complaint and added a class action claim. Their putative class included all migrants and asylum seekers who participated or would later participate in New York City’s “Human Emergency Relief and Response Centers” program to Rockland County and Orange County and who would need transportation, lodging, meals, and/or social service assistance. The plaintiffs also added claims under  New York Executive Law §292(20)(a) and 42 U.S.C. §1981. Also on May 15, the plaintiffs moved for a preliminary injunction to suspend the defendants’ executive orders during the pending litigation.

On June 6, 2023, the federal district court granted the plaintiffs’ preliminary injunction motion. The defendants argued that because the four named plaintiffs already received the hotel accommodations, their claim was now moot. The court said that this was not enough to invalidate the need for a preliminary injunction because there was no guarantee the defendants would enforce this long-term. The defendants also argued that the court should abstain from rendering a decision on the preliminary injunction because there was pending state court litigation from May 11, 2023. The federal district court declined this argument, holding that abstention was not appropriate. The federal court found that a preliminary injunction was appropriate because the plaintiffs had established a substantial likelihood that their Equal Protection Clause rights were violated because the executive orders were not narrowly tailored, and a “fear of thousands of migrants and asylum seekers” was likely not a compelling government purpose. Second, the court also found that the plaintiffs’ §1981 claim would likely succeed because the executive orders were likely issued with a discriminatory motive against migrants and asylees. Third, the court held that the plaintiffs’ Due Process claims would likely succeed because the language of the executive orders curtailed their ability to travel. However, the court rejected the plaintiffs’ claim that the executive orders violated the Supremacy Clause’s preemption doctrine because there was no relevant federal law at issue in this case. 

On September 27, 2023, the plaintiffs moved to certify the putative class.

On October 20, 2023, the defendants filed a motion to dismiss the case for a lack of subject-matter jurisdiction. After the court issued the preliminary injunction on June 6, the defendants revised their executive orders. Instead of directly referring to migrants and asylum seekers, the new executive orders ordered all hotels, motels, and other facilities in the counties to prohibit the construction of short-term housing or shelters that would violate New York’s Social Services Law. 

On July 19, 2024, the court granted the defendants’ motion to dismiss, and it denied the plaintiffs’ motion for class certification as moot. The court held that the defendants’ new executive orders adequately remedied the defects of the original executive orders because they no longer targeted or mentioned migrants, asylum seekers, or homeless people. 

As of April 10, 2026, there is no pending litigation in this case, and the case is not ongoing.

For the foregoing reasons, Plaintiffs' application for a preliminary injunction is GRANTED. The Clerk of the Court is kindly directed to terminate the motions at 12, 53, and 54. The Court makes clear that the grant of preliminary injunction only applies as to the enforcement of the Rockland and Orange County EOs. As Plaintiffs have represented during oral argument and in their moving papers, that is the only relief they seek.
