This case concerns a challenge to Idaho’s abortion bans.  On May 14, 2024 an Idaho physician filed suit for declaratory and injunctive relief in Idaho’s federal court against members of the Idaho Board of Medicine as well as several county prosecutors, all in their official capacity. This case concerns a challenge to Idaho’s abortion bans. 

On May 14, 2024 an Idaho physician filed suit for declaratory and injunctive relief in Idaho’s federal court against members of the Idaho Board of Medicine as well as several county prosecutors, all in their official capacity. Plaintiff was represented by Legal Voice and the Lawyering Project. Plaintiff alleged that Idaho’s abortion bans violated the 14th Amendment’s substantive due process and equal protection clauses by preventing women from being able to access live-saving medical care if they experience pregnancy complications. The case was assigned to Judge Lynn Winmill. 

The defendant county prosecutors filed motions to dismiss on July 16, 

On March 31, 2025 the court ruled on three motions to dismiss, denying defendants’ motion to dismiss for lack of standing and failure to state a claim, and granting two motions to dismiss specific prosecutors from the case. 2025 WL 963957. On the standing issue the court ruled that the plaintiff had both individualized and third party standing sufficient to bring suit.  With regards to the plaintiff’s substantive due process claim, the court found that the constitutional right to an abortion to address life-altering medical complications was “yet to be determined” post-Dobbs and that it could plausibly fail strict scrutiny or rational basis review. On the Equal Protection front, the court found that the law could plausibly be found to treat pregnant people in a medical emergency differently depending on how their medical emergency arose, and thus may present an equal protection problem. 

In the same order, the court granted the plaintiff's motion to amend the complaint. 

This case is ongoing.
