On March 24, 2025, a Columbia undergraduate and lawful permanent resident filed this complaint and petition for writ of habeas corpus in the U.S. District Court for the Southern District of New York, challenging the government's allegedly retaliatory immigration enforcement actions against her in response to her participation in pro-Palestine campus protests. Plaintiff sued President Trump and several high-ranking officials, including the Secretary of State, the Attorney General, and the Secretary of Homeland Security (DHS). The case was assigned to Judge Naomi Reice Buchwald.

Plaintiff immigrated to the U.S. from South Korea at the age of seven and became a lawful permanent resident in 2021. She was arrested on March 5, 2025, for “obstruction of governmental administration" during a student sit-in and protest at Columbia University related to the university’s disciplinary actions against other pro-Palestinian student activists. The complaint asserts that the federal government thereafter engaged in a series of unlawful actions to arrest, detain, and remove her from the United States. For example, it asserts that on March 10, 2025, a federal law enforcement official advised her counsel that her lawful permanent resident status was being "revoked." The plaintiff argued that this targeting was part of a broader pattern by the federal government of using immigration enforcement to suppress speech protected by the First Amendment. 

According to the complaint, DHS and ICE pursued the plaintiff for removal because Secretary of State Marco Rubio determined that her presence harms U.S. foreign policy interests. That determination, she contended, was made pursuant to a new Trump administration policy that permits the deportation of noncitizens who engage in protests if the Secretary of State determines that their presence harms U.S. foreign policy interests. 

Plaintiff argued that the defendants' actions violate the First Amendment, the Due Process Clause of the Fifth Amendment, the Administrative Procedure Act (APA), the Immigration and Nationality Act (INA), and the Non-Delegation Doctrine. She sought the following relief: vacatur of the government's unlawful policy of targeting noncitizens for removal based on First Amended protected speech; vacatur of Secretary Rubio's determination that Chung's presence harms U.S. foreign policy interests; injunctions barring the defendants from detaining or removing Chung from the U.S. during these proceedings; and a declaration that the government’s actions toward Chung are unconstitutional and unlawful.

On March 25, Judge Buchwald issued a temporary restraining order prohibiting the defendants from detaining or transferring the plaintiff pending further proceedings. (elaborate on TRO) The court scheduled a hearing for May 20, 2025.

On April 10, plaintiff sought leave to conduct expedited discovery in support of her motion for a preliminary injunction. On April 11, 2025, the defendants moved to dismiss this action for lack of subject-matter jurisdiction and failure to state a claim; they also opposed Chung's motion for a preliminary injunction. 

On June 5, following a hearing, the court preliminarily enjoined the defendants from arresting or transferring the plaintiff, required 72 hours' notice before any non-removal-based detention to allow for First Amendment retaliation review, and waived the Rule 65(c) bond requirement. The court denied the government's motion to dismiss. 

On July 8, 2025, plaintiff appealed to the U.S. Court of Appeals for the Second Circuit.

In mid-July, Judge Buchwald explained that discovery could not continue while the government appealed the injunction. Plaintiff objected, citing precedent for trial court proceedings moving forward while a preliminary injunction appeal was pending.  She expressed particular concern that her case would otherwise stall until as late as 2027. Plaintiff pointed to the cases of similarly situated individuals whose cases are continuing while an issue is appealed. See, e.g., Öztürk v. Hyde; Khalil v. Trump; Mahdawi v. Trump. Judge Buchwald again refused to hold discovery conferences without word from the 2nd Circuit on the pending appeal.

In mid-July, Plaintiff again sought a conference regarding proposed discovery. Judge Buchwald sent a letter stating that discovery could not continue while the government appealed the injunction. Plaintiff again sought a conference regarding proposed discovery, showing precedent for proceedings continuing contemporaneously with an appeal to an order granting preliminary relief, and expressing particular concern that her case would otherwise stall until as late as 2027 if proceedings did not continue in the district court. See, e.g., Öztürk v. Hyde, No. 25-cv-374 (D. Vt.), ECF 139 (ordering briefing on discovery during appeal); Khalil v. Trump, 25-cv-1963 (D.N.J.), ECF 200– 230, 322–370 (proceedings held during pendency of appeals challenging jurisdiction); Mahdawi v. Trump, No. 25-cv-389 (D. Vt.), ECF 77, 78, 80 (briefing on discovery during appeal). But see id. at ECF 81 (discretionarily deferring adjudication of motion for discovery until resolution of appeal heard on expedited basis). Judge Buchwald again responded with a letter refusing to hold discovery conferences without word from the 2nd Circuit on the pending appeal.

ECF Nos. 60, 62, 63. As the parties know, defendants noticed an appeal on July 3, 2025, to the Second Circuit from the Order granting a preliminary injunction entered [by the District Court] on June 5, 2025. ECF No. 61 (Notice of Appeal). According to the Governments letter of July 3, 2025, ECF No. 62, the appeal is predicated on the argument that this Court lacked subject matter jurisdiction. Id. Further, the Governments letter represented that it is neither seeking to expedite the appeal nor seeking to stay in the Second Circuit this Courts preliminary injunction order. Id. Counsel is no doubt well aware that the filing of a notice of appeal constitutes an event of jurisdictional significance, which confers jurisdiction on the court of appeals and divests the district court of its control over those aspects of the case involved in the appeal. Griggs v. Provident Consumer Discount Co., 459 U.S. 56, 58 (1982). To this Courts understanding, supervising the conduct of discovery is not one of the actions a district court can undertake while an appeal is pending.
