This case challenged the Trump administration’s effective shutdown of Voice of America (VOA) and its grantee networks following Executive Order 14238, “Continuing the Reduction of the Federal Bureaucracy.” On March 26, 2025, VOA Director Michael Abramowitz and three senior staff filed this lawsuit in the U.S. District Court for the District of Columbia against the U.S. Agency for Global Media (USAGM), Senior Advisor Kari Lake, and Acting CEO Victor Morales. Represented by private counsel, plaintiffs alleged violations of the Administrative Procedure Act (APA), the Take Care Clause, and ultra vires agency action.

The case was assigned to Judge Royce C. Lamberth.

The plaintiffs alleged that, following the March 14 executive order, USAGM placed nearly all VOA employees and contractors on leave, canceled external grants, ceased operations of overseas transmitters, and instructed VOA grantees to suspend programming. On March 26, plaintiffs moved for a temporary restraining order and preliminary injunction (PI). The district court held a joint hearing with Widakuswara v. Lake, a related challenge brought by VOA’s Editor-in-Chief.

On April 22, Judge Lamberth granted the preliminary injunction, finding that USAGM’s actions violated 22 U.S.C. §§ 6202 and 6204, which mandate that VOA serve as “a consistently reliable and authoritative source of news.” The order required USAGM to: (1) reinstate affected employees and contractors; (2) restore grant funding to Radio Free Asia and Middle East Broadcasting Networks; and (3) resume VOA programming. Defendants appealed and sought a partial stay. 2025 WL 1176796

On May 3, a D.C. Circuit panel partially granted the stay, pausing the personnel and grant-related provisions (1) and (2), but leaving in effect the order requiring USAGM to resume VOA broadcasting. The panel expressed doubt that the APA provided standing or jurisdiction for broad system-wide reinstatement, and cited sovereign immunity and Tucker Act issues regarding the grantee funding. 2025 WL 1288817

In the district court, plaintiffs moved for contempt, alleging USAGM failed to resume programming. On June 27, Judge Lamberth declined to hold the agency in contempt but ordered detailed monthly compliance reporting on VOA programming. He also denied defendants’ motion to stay district court proceedings pending appeal.

In the D.C. Circuit, appellees sought en banc review to vacate the partial stay. On May 28, the court denied rehearing in Abramowitz (No. 25-5145) but granted it in two companion grantee cases, Radio Free Asia v. Lake and Middle East Broadcasting Networks v. Lake, vacating the stays in those appeals and rejecting the government’s jurisdictional arguments under the Tucker Act. 2025 WL 1521355

On July 1, the D.C. Circuit set oral argument in Abramowitz, Widakuswara, and the companion cases for September 22, 2025. On July 23, the court granted appellees’ motion to file a special appendix in support of their opposition to the appeal.

Meanwhile, back in the district court on July 23, 2025, the plaintiff filed a motion for partial summary judgment that the court granted on August 28, enjoining defendants from removing Abramowitz as VOA Director without the approval of a majority of the board of International Broadcasting Advisory Board. 

On September 29, 2025, the district court issued an order pausing the proposed Reduction in Force at the VOA in order to ensure compliance with the preliminary injunction. Judge Lamberth noted that the government had repeatedly refused to comply with court orders in this case, and that the proposed RIF would severely undermine the ability to uphold prong 3 of the injunction, which declared that VOA programming should be restored. On October 6, the DC Circuit declined to issue an emergency stay.

On November 17, 2025, plaintiffs filed a motion for partial summary judgment, and on November 26, defendants asked the court to stay the motion until the court's decision in Abramowitz v. Lake. 

The case is ongoing.
