This case is one of numerous lawsuits challenging the Trump administration’s abrupt termination of immigration visas—mostly student or work visas—with no notice to the visa-holders and with dubious or no legal basis. You can see all of the cases here.

On March 30, 2025, a Turkish student studying at the University of Minnesota filed a petition for writ of habeas corpus in the United States District Court for the District of Minnesota, alleging unlawful detention by the federal government in violation of his substantive and procedural due process rights. He was detained by immigration enforcement because of a 2023 drunk driving case, and his student visa was revoked several hours later. The case was assigned to Judge Jeffrey M. Bryan.

The court invited the petitioner to amend his pleading on April 10 following developments in the case, including the progression of Gunaydin's immigration case and the proliferation of habeas cases challenging immigration detention in the weeks since the initial petition was filed. Petitioner filed an amended petition the next day. 

As deportation proceedings moved forward in immigration court, the district court issued an order on April 16 requesting the respondents to submit transcripts or recordings of two of the immigration hearings and copies of any written orders issued by the immigration court. On April 17, the court further delayed any hearings on the habeas petition pending the resolution of the immigration proceedings unless either party sought injunctive relief.

The petitioner filed a motion for a temporary restraining order (TRO) on April 25. Three days later, the court granted a 14-day TRO that prohibited the respondents from removing the petitioner from the District of Minnesota. Following a hearing, an oral motion for an extension of the TRO was granted for an additional 14 days. 2025 WL 1218301. Within petitioner's immigration proceedings, on April 30, 2025, the Immigration Judge dismissed the charges of removability and terminated his removal proceedings because DHS failed to prove by clear and convincing evidence that the petitioner was "engaged in dangerous activity" when he committed his DWI offense. The government did not contest the validity of the Immigration Judge's findings or conclusions within their briefs. 

On May 15, 2025, petitioner filed a second amended petition for a writ of habeas corpus. The court granted habeas relief on May 21 finding that his continued detention violated procedural due process where an immigration judge has dismissed the underlying proceedings and ordered his release. The court ordered that Günaydin be released from custody immediately, subject to the conditions previously imposed by the Immigration Judge, including the $5,000 bond. 784 F.Supp.3d 1175.
