On December 20, 2024, the Department of Justice (DOJ/the Department) brought this case against the state of Louisiana and the Louisiana Department of Public Safety and Corrections in the Middle District of Louisiana. On December 20, 2024, the Department of Justice (DOJ/the Department) brought this case against the state of Louisiana and the Louisiana Department of Public Safety and Corrections in the Middle District of Louisiana. The DOJ alleged the Louisiana incarcerated thousands of people each year past their sentences resulting in a system of over detention. The Department filed this case pursuant to the Civil Rights of Institutionalized Persons Act, 42 U.S.C. §§ 1997-1997j (CRIPA), and requested injunctive relief to "end the rampant and longstanding over-detention in Louisiana." Judge Brian A. Jackson was assigned to the case.

In February 2025, after the inauguration of President Trump, Louisiana requested the court to hold all proceedings in abeyance for 90 days while the parties conferred about the status of the case. The DOJ consented to this motion. The court granted this request and administratively closed the case.

Thereafter, on May 8, 2025, the United State withdrew the counsel of record due to the "re-assignment of litigation responsibilities for this action within the United States Department of Justice." That week, Louisiana submitted a second motion for abeyance, and requested the court halt all proceedings for another 90 days.

The court has continued to grant similar motions, and as of October 2025, the case is stayed due to the ongoing government shut down.
