Case Summary

This case challenged mass terminations and office shutdowns at the Department of Health and Human Services (HHS). On March 27, 2025, HHS announced it would send layoff notices to 10,000 full-time employees. On May 5, 2025, nineteen states and the District of Columbia (Plaintiffs) filed this lawsuit in the United States District Court for the District of Rhode Island. Defendants include HHS, its component agencies, including the U.S. Food and Drug Administration, Centers for Disease Control, and several officials of each. Plaintiffs challenged the March 27, 2025 directive, which included: (1) Mass layoffs of 10,000 employees; (2) Restructuring of HHS from twenty-eight divisions to fifteen; and (3) Closure of five of HHS’s regional offices. Plaintiffs alleged that dismantling HHS left the Department unable to carry out its statutory functions, violating the Separation of Powers, Appropriations Clause, and Administrative Procedure Act (APA). Plaintiffs requested declaratory and injunctive relief.

On May 9, 2025, the Plaintiffs moved for a preliminary injunction. The case was assigned to District Judge Melissa R. DuBose, who issued a preliminary injunction on July 1, 2025. Defendants were enjoined from "taking any actions to implement or enforce the planned RIFs or sub-agency restructuring announced" in the directive. The court also "preemptively" denied the Defendants' request for a stay pending any appeal they might decide to file. 2025 WL 1803260.

On July 17, 2025, the Defendants filed a motion to vacate the preliminary injunction, or in the alternative, to stay the preliminary injunction pending appeal. Defendants pointed to New York v. McMahon, which allowed the government to proceed with a reduction-in-force at the Department of Education while litigation over the RIF continued. Therefore, the defendants asked the court to vacate its preliminary injunction or to stay it while they appealed.

On July 18, 2025, the court denied all the Defendants' motions. Rejecting the Defendants' claims that the Supreme Court's stay in McMahon meant that the district court should vacate its preliminary injunction, the court stated that it "w[ould] not interpret the Supreme Court’s shadow docket summary orders (issued without any reasoning or explanation) as definitive indications as to how either the Supreme Court or the First Circuit Court of Appeals might rule on a motion to stay or on the merits of this case." 2025 WL 2410353

On August 12, 2025, the court granted in part the Defendants' motion to clarify the preliminary injunction and issued a revised injunction that named the specific sub-agencies and programs subject to the order. The order enjoined HHS from further implementing its reduction-in-force and restructuring plans. 2025 WL 2410353. The next day, the Defendants filed an appeal in the U.S. Court of Appeals for the First Circuit (USCA Case No. 25-1780) as well as an emergency motion in the appellate court to stay the injunction pending appeal.

On September 17, the U.S. Court of Appeals for the First Circuit denied the Defendants' emergency motion for a stay pending appeal. The First Circuit considers four factors when evaluating a stay motion. Likelihood of success on the merits of defendants’ appeal and risk of irreparable injury to defendants absent a stay are most critical. Nken v. Holder, 556 U.S. 418, 433-34 (2009). The Defendants made three arguments in their stay motion: (1) Plaintiffs lack standing to bring this case; (2) The district court lacks jurisdiction under the Civil Service Reform Act; and (3) Plaintiffs can’t challenge the agency action at issue, as it is neither final nor arbitrary and capricious. The First Circuit found these arguments unlikely to be successful on appeal. Noting that the remaining factors used to evaluate a stay motion did not meet the Defendants’ burden to justify a stay, the First Circuit denied the motion. 2025 WL 2658233.

On October 29, 2025, before briefing was completed, the parties stipulated to dismiss the appeal. The appeal was officially dismissed the following day, on October 23, 2025.

Meanwhile, in the district court on October 3, Defendants moved to stay proceedings because of the government shutdown. In denying Defendants’ motion, Judge DuBose stated that the “Court is required to continue its constitutional functions.”

Defendants filed a motion to dismiss Plaintiffs’ complaint on October 14.

While their motion to dismiss was pending, defendants filed a notice of factual developments on February 9, 2026. The notice responded to plaintiffs’ allegations regarding the reduction of force (RIF) notices for the National Institute for Occupational Safety and Health (NIOSH), and notified the court that on January 13, 2026, HHS rescinded all remaining NIOSH RIF notices, reinstating hundreds of employees to the agency. Following this development, the defendants stated that other litigation challenging the NIOSH RIFs has been held in abeyance at the joint request of the parties.

On March 27, 2026, the defendants filed another notice of factual developments, notifying the court of two developments relevant to the pending litigation: (1) the rescission of all remaining RIF notices issued to employees in the Center for Tobacco Products (CTP) within the Food and Drug Administration (FDA) after the March 27, 2025, announcement and (2) the rescission of all remaining RIF notices issued to employees in the Division of Data and Technical Analysis (DDTA) within the Office of the Assistant Secretary for Planning and Evaluation after the same announcement.

On April 7, 2026, the court issued an order and memorandum denying the defendants’ motion to dismiss. The court found that the plaintiffs successfully argued that these changes have already caused tangible harms, such as missed vaccine deadlines and the disruption of critical public health services. The court determined that it possessed proper jurisdiction and that the states had standing to sue due to these downstream injuries. Furthermore, the court found that the plaintiffs provided plausible allegations that the restructuring may violate the U.S. Constitution and the Administrative Procedure Act. 2026 WL 931532.
