Several lawsuits have been brought challenging the Trump administration’s attempt to dismantle the U.S. Department of Education. This case is one; the others can be found here.

On April 10, 2025, sixteen states and the District of Columbia filed this lawsuit in the United States District Court for the Southern District of New York against the U.S. Department of Education and its Secretary. The states challenged Defendants' revocation of the state's access to funds appropriated to help public schools recover from the effects of COVID-19. They alleged that Defendants' actions violated the Administrative Procedure Act. The case was assigned to District Judge Edgardo Ramos.

On April 11, Plaintiffs moved for a preliminary injunction, subject to an expedited briefing schedule agreed with the Defendants and ordered by the court on April 15. On May 6, the court held argument and the same day issued a preliminary injunction. 2025 WL 1322686. The injunction blocked the challenged reaction letters and further prohibited Defendants from taking any action to modify previously-granted grant approvals without 14 days' notice to the affected state. 2025 WL 1322686. On May 9, 2025, the government filed a status report confirming that the order had been provided to all Department of Education personnel.

On June 4, the court extended the preliminary injunction. That same day, Defendants filed a notice of appeal to the U.S. Court of Appeals for the Second Circuit. On June 6, in the Court of Appeals, they moved for a stay pending appeal and requested an immediate administrative stay while the motion was under consideration. On June 10, the court referred the stay motion to the three-judge motions panel scheduled for June 17 and denied the request for an administrative stay in light of the expedited briefing schedule. 

On June 20, the Court of Appeals denied Defendant-Appellants' motion to stay the district court's order. The Court found that the record supported the conclusion that the Government's actions were likely arbitrary and capricious, and that they failed to meaningfully consider the reliance interests at stake. The Court further determined that a stay would substantially injure the plaintiff states. 

The parties withdrew the appeal from the First Circuit on August 11, and the case returned to the district court. On October 1, 2025, the court granted a one week extension for the Department to respond to the complaint—until October 8— because “the parties have made additional progress in reaching a consensual resolution but require additional time to finalize an agreement, including by obtaining any necessary final approvals.” No response was filed by October 8.
