This case involved a challenge to the Trump administration's effort to freeze federal grants for electric vehicle (EV) charging infrastructure. On May 7, 2025, seventeen states and the District of Columbia sued the Department of Transportation and various sub-agencies and officials to stop the implementation of Executive Order 14,154, "Terminating the Green New Deal," which directed the Federal Highway Administration (FHWA) to suspend the National Electric Vehicle Infrastructure (NEVI) Formula Program. The states brought claims under the Administrative Procedure Act and the Constitution, alleging that the suspension of Formula grants for EV charging stations is unlawful and violates separation of powers. The case was assigned to District Judge Tanya Lin.

On May 7, plaintiffs filed a motion for a preliminary injunction (PI). On May 22, several public interest organizations, including the Sierra Club and the Natural Resources Defense Council, filed a motion to intervene as party plaintiffs. 

Following a hearing on June 17, the court granted the motion for a PI as to 14 of the plaintiff states, finding a likelihood of success on the merits of their APA and separation of powers claims. The court denied the motion in part, finding that the District of Columbia, Minnesota, and Vermont failed to demonstrate irreparable harm beyond the allegations set forth in the complaint. Defendants were enjoined from suspending or revoking plaintiffs' previously approved State Electric Vehicle Infrastructure Deployment Plans – which are required annual submissions outlining how each state will use funding – and from withholding NEVI Formula Program funds.

The plaintiffs filed an Amended Complaint on August 1, 2025, which added Kentucky, Michigan, Pennsylvania, and North Carolina as Plaintiffs 

Both parties moved for summary judgment on August 26, 2025. The plaintiffs requested oral argument. The intervenor plaintiffs moved for summary judgment on September 2, 2025. 

On January 23, 2026, following a motions hearing, the court granted summary judgment for the plaintiffs, ruling that the DOT and FHWA acted unlawfully when they abruptly froze the NEVI Formula Program. The court found that the federal government's decision to rescind program guidance and revoke state deployment plans violated the Administrative Procedure Act. Consequently, the court vacated the revocation of state plans, effectively restoring the legal status quo that existed before the freeze. The court additionally issued a permanent injunction, enjoining the defendants from withholding NEVI funds for reasons not found in the IIJA and are prohibited from refusing to process authorization requests for specific projects. The court formally declared that the suspension of the program was arbitrary, capricious, and in excess of statutory authority. However, the court declined to rule on the Plaintiffs' Constitutional (Take Care Clause/Separation of Powers) and common law (ultra vires) claims, noting that because the Plaintiffs prevailed on the APA claims, reaching these constitutional issues was unnecessary. 2026 WL 183584.
