This cases challenged certain tariffs placed on China in 2018 and 2019. Maple Trade Corporation v. United States, filed a few days after this case raised the same arguments as this case. 

On May 14, 2025 a Canadian auto parts maker, GK Industries America, and an affiliate, brought this tariff challenge in the Court of International Trade. Plaintiffs, represented by private counsel, sued the United States, U.S. Customs and Border Protection, and the U.S. Trade Representative, arguing that two tariff schedules against China set in 2018 and 2019 exceeded the President's tariff authority under the Trade Act of 1974, 19 U.S.C. § 2411 et seq. Plaintiffs sought to invalidate certain actions, obtain a permanent injunction against the challenged tariffs, and have payments under the tariffs made in the two years prior to suit refunded.

On May 16, the case was stayed pursuant to Administrative Order 21-02, which stated that all tariff cases filed under Section 301 after April 1, 2021 would be stayed upon commencement.

As of October 24, Plaintiffs had not taken any further action.

The case is ongoing.
