 This case challenges allegedly inhumane detention conditions faced by noncitizens held in U.S. Immigration and Customs Enforcement (ICE) holding cells in Maryland. On May 9, 2025, a noncitizen detained by ICE in holding cells operated by ICE’s Baltimore Field Office filed this putative class action lawsuit in the U.S. District Court for the District of Maryland against several ICE officials, the Secretary of Homeland Security, and the Attorney General. Petitioners brought claims under the Administrative Procedure Act and the Due Process Clause, alleging inhumane conditions in the holding cells. They alleged that defendants denied them access to food, water, necessary medical care, bathrooms, and phones, thereby preventing meaningful access to counsel.

Represented by private counsel, petitioners sought (1) declaratory relief; (2) injunctive relief to remedy the alleged inhumane conditions in the ICE holding cells; and (3) a writ of habeas corpus challenging the lawfulness of their detention.

The case was assigned to District Judge Julie Rebecca Rubin. The court directed the clerk to re-docket the case as a non-habeas civil action. (For this reason, certain documents now on the docket, under number 1:25-cv-01613, are misdated, reflecting the date of transfer to the new docket rather than the original filing date.)

The complaint was amended twice. The first amendment added an additional petitioner and a proposed class representative. The second added factual allegations and defined the proposed class as “All persons who are now or in the future will be detained at the Baltimore Hold Rooms.” The court allowed the named petitioners to proceed under initials or pseudonyms but declined to grant a blanket allowance for all putative class members. 2025 WL 2062184.

On May 13, the named plaintiffs moved to enjoin their removal from the continental United States during the pendency of the action. The next day, the court granted this motion pursuant to the All Writs Act, 28 U.S.C. § 1651(a).

Following that order, the plaintiffs filed a motion for a preliminary injunction, seeking guaranteed access to food, water, bathrooms, medical care, and phones. On June 18, 2025, the State of Maryland filed an amicus brief supporting the motion. The brief argued that the alleged conditions violated Maryland’s safety and dignity standards for detention facilities, were unconstitutional, and were contrary to the public interest and the State’s values. It urged the court to grant the injunction to compel reforms consistent with constitutional protections and state standards.

On July 25, the court denied the motion for class certification. It reasoned that the evidentiary record suggested the named plaintiffs did not play an active role in the suit and thus were not adequate class representatives. Further, the claims arose from varied conduct and practices, supported by declarations describing both common and unique experiences, defeating commonality.

In light of the denial of class certification, the court also denied the plaintiffs’ motion for preliminary injunctive relief as moot. Although the plaintiffs had been transferred out of the Baltimore Hold Rooms and argued that the case was not moot because the putative class claims remained live, the court held that because the named plaintiffs’ individual claims were moot and class certification had been denied, no live issues remained for purposes of the preliminary injunction. 2025 WL 2098633.

On September 9, the government moved to dismiss the complaint. Preliminary discovery has been stayed due to the government shutdown. However, the court declined to stay the plaintiffs’ individual habeas claims.

On October 20, both parties submitted notice that the Eighth, Ninth, Tenth, and Eleventh Causes of Action in the Second Amended Complaint, each asserted only on behalf of the named plaintiffs, were dismissed without prejudice.

The case remains ongoing.
