Case Summary

[This summary is temporary while we research the case]. On August 16, 2023, two national organizations—International Partners for Ethical Care, Inc. (IPEC) and Advocates Protecting Children (APC)—along with several Washington parents challenged three state laws: (1) Wash. Rev. Code § 71.34.530, allowing minors age 13 and older to seek outpatient mental health treatment without parental consent; (2) ESSB 5599 (2023), which limits parental notification when minors seek “protected health care services,” including gender-affirming care; and (3) SHB 1406 (2023), which expands shelter services allowing minors to remain in licensed shelters without parental permission under certain conditions. Plaintiffs alleged these laws violated the Due Process, Free Exercise, and Free Speech Clauses.
