On November 22, 2024, Women’s Life Care Center, Dakota Hope Clinic, and the National Institute of Family and Life Advocates, together with several doctors and mothers, filed a lawsuit in the U.S. District Court for the District of Minnesota against state officials including Attorney General Keith Ellison and Governor Tim Walz, as well as abortion providers and clinics, including Planned Parenthood branches.

The plaintiffs argued that the Fourteenth Amendment protects a mother’s constitutional right to maintain her relationship with her unborn child. They claimed that abortion terminates this relationship in the same way that adoption or termination of parental rights does, and therefore should require judicial procedures, including a hearing, to ensure the woman’s choice is knowing and voluntary. They also asserted that Minnesota’s abortion framework violated equal protection by treating unborn children differently depending on whether their lives were ended by abortion or by other criminal acts. The plaintiffs sought declaratory and injunctive relief, damages, and attorneys’ fees. The case was assigned to District Judge Nancy E. Brasel.

On August 27, 2025, Judge Brasel dismissed the case. She pointed out that the complaint did not clearly identify which abortion statutes were being challenged and instead referred broadly to Minnesota’s “abortion regime,” making the claims too vague. She also noted that existing precedent does not recognize a judicial hearing requirement before abortion as a substantive due process right. In rejecting the plaintiffs’ standing arguments, the court relied heavily on the Supreme Court’s recent decision in Food and Drug Administration v. Alliance for Hippocratic Medicine, which reaffirmed that doctors and organizations generally cannot claim standing based on indirect or generalized injuries in abortion litigation. Judge Brasel further explained that the plaintiffs lacked standing: the doctors could not show concrete injury, and the organizations lacked associational or third-party standing. In addition, the abortion providers could not be treated as state actors for purposes of constitutional claims, and the Eleventh Amendment barred damages claims against state officials. For these reasons, the case was dismissed in full and, therefore, the plaintiffs’ motion for preliminary injunction was denied as moot.
