On June 24, 2025, the Central American Refugee Center (CARECEN), Haitian American Family of Long Island (HAFALI), the Episcopal Diocese of Long Island, civil rights activist Marc Soto, and an anonymous undocumented resident filed this article 78 petition against Nassau County Police Department (NCPD) and Nassau County challenging NCPD’s March 2025 decision to enter into an agreement with U.S. Immigration and Customs Enforcement (ICE) pursuant to INA  Section 287(g). The agreement gave local law enforcement authority to work with ICE, in direct violation of Article 9, § 1(c) of the New York Constitution, which provides that a county may not contract to provide services it does not have the authority to provide. Plaintiffs brought suit in the Supreme Court of Nassau County seeking preliminary and permanent injunctions setting aside the agreement as unlawful, plus attorneys' fees. The case was assigned to Judge Danielle M. Peterson. 

On August 29, 2025, Nassau County filed a motion opposing Plaintiffs' preliminary injunction. Plaintiffs filed their reply brief to the motion on September 5, 2025. As of February 13, 2026, no decision has been published regarding the motion for preliminary injunction, nor have further motions been filed.

This case is ongoing.
