Collectively, these suits allege that the defendant states failed to comply with federal requirements for voter list maintenance and refused to provide the Attorney General with voter registration data necessary to verify compliance.  Here are all the DOJ Voter Data lawsuits in the Clearinghouse collection. 

The United States sued the State of Minnesota and Steve Simon, in his official capacity as Minnesota Secretary of State, for violating the Civil Rights Act of 1960 (CRA) and the Help America Vote Act of 2002 (HAVA) by refusing to provide an unredacted copy of Minnesota’s Statewide Voter Registration List (SVRL). The Department requested the list—including voter names, residential addresses, dates of birth, driver’s license numbers, and the last four digits of Social Security numbers—as well as documents describing Minnesota’s procedures for maintaining accurate rolls.

The complaint details a months-long exchange between the DOJ Civil Rights Division’s Voting Section and the Minnesota Secretary of State’s Office. In response to DOJ’s June 25 and August 13, 2025, letters demanding the SVRL, Minnesota officials refused, citing state privacy laws that prohibit disclosure of certain voter information. DOJ argues these laws are preempted by federal law and highlights that Minnesota already provides identical data to the Electronic Registration Information Center (ERIC), a private interstate data-sharing organization, undermining the claimed privacy rationale.

The complaint asserts two causes of action:

  1. Civil Rights Act of 1960 (52 U.S.C. § 20703): Minnesota unlawfully refused to produce voter registration records demanded by the Attorney General.
  2. Help America Vote Act (52 U.S.C. § 21083): Minnesota failed to comply with HAVA’s list-maintenance requirements and obstructed the Attorney General’s ability to assess that compliance.
    The United States seeks declaratory and injunctive relief requiring Minnesota to provide a complete, electronic copy of its SVRL—including all identifying fields for active and inactive voters—and to declare that any conflicting provisions of state law are preempted by the CRA and HAVA. No monetary damages or attorneys’ fees are requested.

On October 14, 2025, the League of Women Voters Minnesota, Common Cause, and individual voters Jennifer Compeau and Valerie Mangskau filed a brief supporting their motion to intervene as defendants in United States of America v. Steve Simon in the U.S. District Court for the District of Minnesota. They argued that DOJ’s demand for Minnesota’s full, unredacted voter registration list threatened their legally protected privacy and voting interests, entitled them to intervention as of right, and, alternatively, warranted permissive intervention because their participation would aid the court without delaying the case.

On December 23, 2025, the State of Minnesota and Secretary of State Steve Simon filed a motion to dismiss the complaint for failure to state a claim. Defendants argued that neither the Help America Vote Act nor the Civil Rights Act of 1960 authorized the Department of Justice to demand wholesale production of Minnesota’s unredacted statewide voter registration data. They contended that Minnesota had fully explained its voter-list maintenance procedures, that DOJ alleged no deficiencies in those procedures, and that federal law did not grant DOJ investigative authority to compel production of sensitive voter data. Defendants further argued that the Civil Rights Act’s records-inspection provision was limited to investigating racially discriminatory voting practices and could not be used to assess HAVA compliance, and that Minnesota’s refusal to produce the data was consistent with state and federal privacy protections

On January 12, 2026, the United States filed a notice of decision informing the court of a related ruling in a parallel DOJ enforcement action challenging a different state’s refusal to produce statewide voter registration records. In United States v. Thomas, No. 3:26-cv-00021 (D. Conn.), the U.S. District Court for the District of Connecticut issued an Order to Show Cause requiring the Connecticut Secretary of State to explain why she should not be ordered to produce the Statewide Voter Registration List and related records demanded by the Attorney General under Title III of the Civil Rights Act of 1960. The United States cited the decision to support its position that, once the Attorney General alleges a proper demand and refusal under the Civil Rights Act, the district court’s role is limited to ordering the custodian to show cause, without entertaining alternative procedural challenges. As of January 2026, Minnesota’s motion to dismiss and the United States’ motion to compel production remained pending.
