The plaintiffs allege that HUD has imposed new, unlawful requirements on them to comply with current and future Executive Orders issued by the Trump administration relating to “diversity, equity, and inclusion”; “gender ideology”; immigration; and elective abortions (hereinafter, "HUD Grant Conditions"). HUD demanded that the agencies certify that they will comply with these orders or lose federal funding. The complaint requests that the agency action be set aside as unlawful and that the government be enjoined from terminating the plaintiffs' funding. The plaintiffs filed this complaint in the United States District Court for the Northern District of California, and the district assigned Judge Jon S. Tigar to the case.

The plaintiffs moved for a temporary restraining order (TRO) on October 16, 2025. Plaintiffs alleged they would suffer irreparable harm because they “are being compelled to agree to vague, ambiguous, and unlawful conditions at the risk of incurring financial penalties and legal liability, or giving up funds already awarded and, in many cases, accounted for in budget and project planning.” The court granted the TRO two days later, finding that the plaintiffs were likely to succeed on the merits and that it would not be prejudicial to the government to maintain the status quo.

The court granted a preliminary injunction extending the terms of the TRO on November 14, 2025. The court rejected the defendants’ proposal that the Court “tailor relief to reach only the grant conditions and plaintiffs for which all emergency relief requirements are satisfied.” Judge Tigar wrote that since all plaintiffs faced immediate harm and all the grant conditions were unconstitutional, no additional tailoring of the preliminary injunction was warranted.
