On October 31, 2024, Donald Trump sued CBS Broadcasting and CBS Interactive, Inc. in the U.S. District Court for the Northern District of Texas. On October 31, 2024, Donald Trump sued CBS Broadcasting and CBS Interactive, Inc. in the U.S. District Court for the Northern District of Texas. Trump alleged that CBS engaged in "partisan and unlawful acts of election and voter interference through malicious, deceptive, and substantial news distortion" in order to sway the 2024 election towards the Democratic Party. Specifically, Trump alleged that CBS and similar media platforms glossed over disqualifying policy failures and campaign gaffes on the part of Vice President Kamala Harris. Filing under several provisions of Tex. Bus. & Comm. Code § 17.46 and §17.50, Trump sought a jury trial, damages approximated at $10,000,000,000, and an order enjoining CBS’s "false, misleading, and deceptive acts." The case was assigned to District Judge Matthew J. Kacsmaryk.

On December 6, 2024, Defendants filed two motions to dismiss. They argued for dismissal based on lack of personal jurisdiction and improper venue, or alternatively to transfer the case to the U.S. District Court for the Southern District of New York. They also moved to dismiss for lack of subject-matter jurisdiction and failure to state a claim, arguing the First Amendment protects editorial judgments, that the Texas law under which Trump sued does not apply to non-commercial speech, and that Trump lacked standing as he ultimately won the election.

On February 7, 2025, Trump filed an Amended Complaint, adding Representative Ronny Jackson as a plaintiff and Paramount Global as a defendant. The Amended Complaint added a federal claim for false advertising and unfair competition under the Lanham Act, alleging that the "deceptive mislabeling" of the interview diverted viewership from President Trump's media ventures, including Truth Social. Following this filing, on February 10, 2025, Judge Kacsmaryk denied Defendants' initial motions to dismiss as moot.

On March 6, 2025, Defendants filed new motions to dismiss the Amended Complaint. They renewed their arguments regarding lack of personal jurisdiction and improper venue, again seeking transfer to the Southern District of New York. They also moved to dismiss for lack of subject-matter jurisdiction and failure to state a claim, asserting that the Lanham Act and the Texas statutes do not apply to editorial speech, that Plaintiffs lack Article III standing, and that the claims are barred by the First Amendment.

Following a mediated settlement, Paramount (CBS' parent company) agreed to pay $16 million towards President Trump's presidential library. Read more at this link. The parties submitted a joint stipulation to dismiss the suit with prejudice on July 22, 2025.
