Case Summary

This is a challenge to the policy and practice of denying bond hearings to detained noncitizens at the Northwest ICE Processing Center (NWIPC) in Tacoma, Washington. The plaintiff in this case is a resident of Washington state who was detained at the NWIPC and denied bond by the Tacoma Immigration Court on March 12, 2025. This is a challenge to the policy and practice of denying bond hearings to detained noncitizens at the Northwest ICE Processing Center (NWIPC) in Tacoma, Washington.

The plaintiff in this case is a resident of Washington state who was detained at the NWIPC and denied bond by the Tacoma Immigration Court on March 12, 2025. He filed this putative class action lawsuit and petition for a writ of habeas corpus in the U.S. District Court for the Western District of Washington on March 20, 2025, against officials from ICE, the Department of Homeland Security, and the Executive Office for Immigration Review (EOIR).

The complaint alleged that immigration judges at the Tacoma Immigration Court have adopted a policy of denying bond to all noncitizens who entered the U.S. without inspection, wrongly classifying them as subject to mandatory detention under 8 U.S.C. § 1225(b)(2) rather than the discretionary detention statute, 8 U.S.C. § 1226(a), which allows for bond hearings. The plaintiff argued this practice violates the Immigration and Nationality Act (INA), the Administrative Procedure Act (APA), and the Due Process Clause of the U.S. Constitution. Additionally, the complaint challenged the Board of Immigration Appeals' (BIA) practice of delaying decisions on bond appeals for over six months, rendering the right to appeal "virtually meaningless".

Represented by the Northwest Immigrant Rights Project, the plaintiff sought: (1) certification of two classes: a "Bond Denial Class" (those denied bond hearings due to the misclassification) and a "Bond Appeal Class" (those facing prolonged delays in BIA appeals); (2) a declaratory judgment that class members are entitled to bond hearings under § 1226(a) and timely appeal decisions within 60 days; (3) a writ of habeas corpus requiring the defendants to release the plaintiff or provide him with a compliant bond hearing; and (4) reasonable attorneys’ fees and costs.

Also on March 20, the plaintiff filed a motion for a preliminary injunction requesting an individualized custody hearing. On April 24, 2025, the court granted the preliminary injunction, finding that the plaintiff was likely to succeed on the merits of his claim that he is unlawfully detained under the mandatory detention statute (§ 1225(b)) rather than the discretionary one (§ 1226(a)). The court waived the requirement for administrative exhaustion and ordered the defendants to provide the plaintiff with a bond hearing under § 1226(a) within 14 days. (779 F.Supp.3d 1239)

On May 2, 2025, the court granted in part and denied in part the plaintiff's motion for class certification. The court certified the "Bond Denial Class" regarding the detention policy claims. It also certified the "Bond Appeal Class," but limited this certification to the plaintiff's Due Process claims, denying certification for the APA unreasonable delay claims.

On May 14, 2025, the plaintiff filed a motion for a temporary restraining order on behalf of a particular class member. The motion alleged that on May 8, despite the court's preliminary injunction, an Assistant Chief Immigration Judge denied that class member bond solely based on the mandatory detention policy under § 1225(b)(2). The judge noted in the alternative that, were the class member eligible for a hearing under § 1226(a), she would grant release on a $5,000 bond. The motion sought an order requiring the defendants to release the class member upon payment of that bond.

On July 8, 2025, the Department of Homeland Security (DHS) issued a memorandum instructing all ICE employees to adopt the interpretation challenged in this case as national policy, effectively rendering all noncitizens present without admission ineligible for release except by discretionary parole.

On September 30, 2025, the Court granted the Plaintiffs' motion for partial summary judgment regarding the Bond Denial Class and denied the Defendants' motion to dismiss. The Court issued a declaratory judgment stating that members of the Bond Denial Class are detained under the discretionary authority of 8 U.S.C. § 1226(a) and are not subject to mandatory detention under § 1225(b)(2). The Court further declared that the practice of denying bond to these class members based on § 1225(b)(2) violates the Immigration and Nationality Act. While the Court noted that the named plaintiff's individual claims were moot, it found that the Bond Appeal Class had stated a plausible claim regarding the due process violations caused by BIA delays, allowing those claims to proceed. On October 29, 2025, the defendants filed a notice of appeal.

The Court further declares that the Tacoma Immigration Courts practice of denying bond to Bond Denial Class members on the basis of § 1225(b)(2) violates the Immigration and Nationality Act. As set forth in the class certification order, the Bond Denial Class is defined as all noncitizens without lawful status detained at the Northwest ICE Processing Center who (1) have entered or will enter the United States without inspection, (2) are not apprehended upon arrival, (3) are not or will not be subject to detention under 8 U.S.C. §1226(c), § 1225(b)(1), or § 1231 at the time the noncitizen is scheduled for or requests a bond hearing. The Court declares that Bond Denial Class members are detained under 8 U.S.C.§1226(a) and are not subject to mandatory detention under 8 U.S.C. § 1225(b)(2).The Court further declares that the Tacoma Immigration Court's practice of denying bond to Bond Denial Class members on the basis of § 1225(b)(2) violates the Immigration and Nationality Act. MINUTE ORDER at the direction of District Judge Tiffany M. Cartwright: Plaintiff's motion to expedite briefing Dkt. [79] is GRANTED IN PART and DENIED IN PART. The Court agrees with Defendants that motions to shorten time are procedurally improper under the Local Civil Rules and it is rare that briefing will be expedited in a typical civil case. The parties are usually expected to cooperate on briefing schedules that depart from the Local Civil Rules or use the telephonic hearing procedure under Local Civil Rule 7 for true emergencies. The Court also agrees with Defendants that four business days would be an unreasonably short amount of time for Defendants to respond to the motion. The Court, however, is faced with its own scheduling constraints due to the lapse in federal appropriations and intends to schedule a hearing on Plaintiffs Motion for Further Relief (Dkt. 74) for Thursday, November 20, 2025. To accommodate that hearing date, based on the Courts inherent power to manage its docket, the Court ORDERS that Defendants response to the Motion for Further Relief shall be filed no later than November 14, 2025. Plaintiffs reply shall be filed no later than November 19, 2025. The Clerk is respectfully requested to re-note the Motion for Further Relief Dkt. [74] for November 20, 2025.
