On April 30, 2025, two current students and two alumni of UT Austin filed a lawsuit in the U.S. District Court for the Western District of Texas against UT Austin, the University of Texas System Board of Regents (the Regents), the President of UT Austin, the Chairman of the Board of Regents, University of Texas Police Department (UTPD) officers, Texas Department of Public Safety (DPS) officers, and the Governor of Texas. The plaintiffs brought claims under 42 U.S.C. § 1983 for violations of the First and Fourth Amendments, as well as claims under Title VI of the Civil Rights Act of 1964. The plaintiffs sought a declaratory judgment, damages, and attorneys’ fees. The case was assigned to Judge David A. Ezra.

In their complaint, the plaintiffs allege that UT Austin, the Regents, and individual defendants violated their First Amendment rights by engaging in viewpoint discrimination during the April 2024 protest and retaliating against them with coordinated arrests and university discipline to deter future advocacy. They further claim that UTPD and DPS officers violated the Fourth Amendment by arresting them without probable cause and deploying excessive force. Finally, the complaint asserts that UT Austin and the Regents violated Title VI of the Civil Rights Act by intentionally subjecting the plaintiffs to arrest and disciplinary measures (including campus bans and threats of suspension) based on their association with Palestinians and/or Muslims and their pro-Palestine advocacy.

On July 2, 2025, Christopher Wray, a UTPD officer, filed a motion to dismiss for failure to state a claim. Twelve days later, the remaining defendants submitted a separate motion to dismiss.

The plaintiffs filed an amended complaint on July 23, 2025. The amended complaint removed three defendants (Supervising UTPD Officer Adan Zavala and two John Doe UTPD officers) and added Jim Davis in his official capacity as Interim President. It also reorganized the claims by subdividing each of the four counts into separate claims asserted by each plaintiff against specific groups of defendants. In addition, the amended complaint expanded the factual allegations, including new sections addressing UT Austin’s First Amendment policies and detailing alleged differential treatment during the April 2024 protest.

Defendant Wray filed a motion to dismiss the amended complaint on July 28, 2025. The remaining defendants filed a motion to dismiss the amended complaint on August 20, 2025.

On January 27, 2026, the court granted in part and denied in part the defendants’ motion to dismiss. All claims against UT Austin and the Regents were dismissed for lack of subject matter jurisdiction based on sovereign immunity. The court also dismissed all individual-capacity First Amendment and Fourth Amendment claims on qualified immunity grounds and dismissed several defendants, including defendant Wray, for lack of personal involvement. However, the court allowed the First Amendment retaliation claim to proceed against the Interim President and the Regent Board Chair in their official capacities only, finding sufficient allegations of retaliatory motive and ongoing harm to support prospective relief in the form of expungement of disciplinary records.

On February 23, 2026, the plaintiff appealed the January 27, 2026 order to the U.S. Court of Appeals for the Fifth Circuit. 

On the same day, two defendants filed an unopposed motion to pause the case until the appeal is resolved, and the court granted it on March 4, 2026.
