On November 10, the Bureau of Ocean Energy Management (BOEM) published a Final Notice of Sale for the Gulf Lease Sale. The sale, to be held on December 10, will be the first of 30 Gulf sales that will take place between 2025 and 2040.

Environmental nonprofits, including Healthy Gulf, Friends of the Earth, Center for Biological Diversity, National Resources Defense Council, and Sierra Club (Plaintiffs) brought suit in the United States District for the District of Columbia. The lawsuit named Secretary of the Interior Doug Burgum, Acting Director of the Bureau of Ocean Energy Management Matthew Giacona, the U.S. Department of Interior, and the Bureau of Ocean Energy Management as Defendants. Plaintiffs allege Defendants violated both the National Environmental Protection Act (NEPA) and APA by failing to follow mandatory environmental reviewed procedures ahead of the Gulf Lease Sale. 

NEPA requires that federal agencies prepare an Environmental Impact Statement (EIS) evaluating federal actions that may affect the quality of the human environment. While preparing an EIS, the agency must ensure “scientific integrity” and “make use of reliable data and resources.” Plaintiffs allege that the EIS for the Gulf Lease Sale fails to properly consider reasonably foreseeable environmental impacts on the Gulf region. The EIS, according to plaintiffs, fails to consider the risk of an oil spill, address idle or abandoned oil and gas infrastructure in the Gulf region, or consider alternatives for a Gulf sale. Plaintiffs allege that the EIS fails to provide evidence of reasoned decisionmaking, as is required by both NEPA and the APA.

Plaintiffs also allege that Giacona’s involvement with the Gulf Lease Sale is improper and in violation of the APA. Prior to his appointment, Giacona lobbied on behalf of companies in Gulf lease sales while at the National Ocean Industries Association. Giacona was instructed, by the Department of Interior Ethics Office, to recuse himself from any matters that would implicate the financial interests of members companies of the National Ocean Industries Association. Plaintiffs allege that Giacona’s failure to recuse himself on any matters related to the Gulf Lease Sale is an abuse of discretion, in violation of the APA. 

Plaintiffs asked the court to issue a declaration that Defendant’s decision to hold the Gulf Lease Sale violates NEPA and the APA, to vacate the Final Notice of Sale for the Gulf Lease Sale, and to vacate or enjoin any leases issued during the Gulf Lease Sale. 

As of November 23, this case is ongoing.
