On December 23, 2025, the State of Minnesota, through Attorney General Keith Ellison, filed suit in the U.S. District Court for the District of Minnesota against the U.S. Department of Agriculture (USDA) and Secretary Brooke Rollins to challenge the legality of a December 16, 2025 USDA letter (the "Recertification Letter") ordering the State to “recertify” more than 100,000 SNAP households across four counties within 30 days through mandatory in-person interviews. On December 23, 2025, the State of Minnesota, through Attorney General Keith Ellison, filed suit in the U.S. District Court for the District of Minnesota against the U.S. Department of Agriculture (USDA) and Secretary Brooke Rollins to challenge the legality of a December 16, 2025 USDA letter (the "Recertification Letter") ordering the State to “recertify” more than 100,000 SNAP households across four counties within 30 days through mandatory in-person interviews. If Minnesota failed to comply, Secretary Collins threatened the State with severe sanctions - including statewide disqualification from SNAP - an action which could cause over 100,000 Minnesotans to go hungry. Minnesota sought declaratory and injunctive relief under the Administrative Procedure Act (APA) and Spending Clause of the Constitution. The State argued that the letter was unlawful, failed to follow proper notice and comment procedure, and was arbitrary and capricious under the APA. The State argued that the letter's threatened consequences for noncompliances violated the Spending Clause because Minnesota did not have "clear notice" of this condition when it agreed to participate in SNAP. This case was assigned to Judge Laura M. Provinzino.

On December 29, 2025, plaintiffs filed a motion for a preliminary injunction, arguing that Minnesota faced immediate and irreparable harm due to the mass hunger which would occur if SNAP funding were withdrawn. Defendants filed their motion in opposition to the motion for preliminary injunction on January 8, 2026. 

On January 14, 2026, USDA sent a second letter to Minnesota making good on the threats from the initial letter. The second letter informed Minnesota that USDA would immediately withhold administrative funding it was required to provide. Plaintiffs requested that the court also preliminarily enjoin the second letter.

On January 16, 2026, Judge Provinzino granted plaintiffs' motion for a preliminary injunction, finding that plaintiffs were likely to prevail on their claim that the Recertification Letter is procedurally and substantively invalid. 2026 WL 125180. The court found that Minnesota had operated its SNAP recertification in compliance with federal law and with the blessing USDA prior to the Recertification Letter. The court did not reach Minnesota's constitutional claim. The court preliminarily enjoined USDA from taking any adverse action against Minnesota based on either the Recertification Letter or the Enforcement Letter.

On January 17, 2026, Defendants filed notice of appeal.

This case is ongoing.
