Several organizations including United Spinal Association, Not Dead Yet, Institute for Patients' Rights, and Atlantis ADAPT, along with an individual plaintiff, filed suit in the United States District Court for the District of Colorado against the Colorado Governor in his official capacity, the Colorado Department of Public Health and Environment and its Director, and the Colorado Medical Board and its President. The case was assigned to US District Court Judge Regina M. Rodriguez.

The lawsuit challenged Colorado's End of Life Options Act (EOLOA), which allows physicians and advanced practice nurses to prescribe lethal drugs to patients diagnosed as terminally ill and expected to die within six months⁻. Plaintiffs alleged that EOLOA created a discriminatory system where people with life-threatening disabilities who expressed suicidal thoughts were steered toward assisted suicide rather than receiving the suicide prevention services that would be provided to non-disabled individuals. The plaintiffs brought claims under federal civil rights statutes including the Americans with Disabilities Act, Section 504 of the Rehabilitation Act, Section 1557 of the Affordable Care Act, and the Fourteenth Amendment's Equal Protection and Due Process Clauses. They sought declaratory relief, preliminary and permanent injunctive relief to stop enforcement of EOLOA, and reasonable attorneys' fees and costs.

Defendants filed a joint motion to dismiss in September 2025. The case is ongoing.
