Case Summary

On February 18, 2026, plaintiffs - a coalition of health, environmental, and social justice nonprofits including American Public Health Association - petitioned the U.S. Court of Appeals for the District of Columbia for review of a final action by the U.S. Environmental Protection Agency and its director. The measure at issue, entitled “Rescission of the Greenhouse Gas Endangerment Finding and Motor Vehicle Greenhouse Gas Emission Standards Under the Clean Air Act,” repealed all greenhouse gas emission standards for light-to-heavy duty vehicles beginning in 2012. Plaintiffs brought this petition for review pursuant to Clean Air Act (CAA) Section 7607(b)(1), 42 U.S.C. § 7607(b)(1); Federal Rule of Appellate Procedure 15(a); and D.C. Circuit Rule 15(a)(1). Petitioners raised a number of statutory arguments under the Administrative Procedure Act (APA) and the CAA.
