Plaintiff, a Mexican citizen who had lived in the United States for over 27 years with valid DACA status since 2013, was detained during a voluntary USCIS hearing on February 18, 2026, and removed to Mexico the following morning without receiving a copy of the final removal order. Plaintiff filed a motion for a temporary restraining order (TRO) on March 10, 2026, which the court granted on March 23, 2026.

In its opinion regarding the TRO, the court found that her removal while holding active DACA status violated her due process rights, as her DACA approval explicitly stated it constituted "an exercise of prosecutorial discretion by USCIS not to pursue [her] removal". The court rejected the government's jurisdictional challenges, finding that the extreme circumstances exception applied because removal during active DACA status warranted continued jurisdiction. The court ordered Juarez's immediate return to the United States with restoration of her DACA protections.
